Purchase due to complete on 7th August but have had NOTHING from solicitor

    Perhaps the vendors have no further purchase planned, so are happy to exchange and complete same day?

    I would push for exchange anyway, just for security.

    Hello folks,

    Thank you for all your advice

    I sum up your postings as follows
    • In theory we could exchange and complete in 11 (now 9!) days
    • However this is unlikely
    • This kind of delay is not really that normal
    • It is ok to chase up when I think other parties are being slow (and that is not too controlling, actually, Mr Banwa)
    • Yes it is ok to ask the solicitor to send me what she has so far.
    • If the solicitor looks like the girl from Roadhouse, it will probably be ok
    So I rang my lovely solicitor today who kind of confirmed that
    • It is highly unlikely that we will complete on 7th August
    • We are still quite a long way from exchange
    • I MUST NOT under any circumstances contact the council to ask for copies of the building regs because (and she explained this to me twice and I still wasn't sure I completely understood but didn't want to ask her again) IF there are none and the vendor's sols have to admit that, they offer some sort of insurance. However if I alert the council to the fact that there are none, we won't get that from the vendor's sols. If anyone has any experience of this, I would love to hear from them
    • The only place can get the details for the small (£198) subsidence claim in 1997 is the vendor or their mortgage company. She needs this to send to our mortgage company.
    • The mortgage company could take up to 10 days to release funds after that
    • The vendors solicitors are taking their time. One might even say 'stalling'. Saying they haven't received letters. My sol sent a letter on 9th July, then another on 23rd asking them to reply to it, to which they replied that they had never received the letter, which she then emailed a copy of, and they STILL haven't replied. (too much detail?)
    • She is sending me copies of everything she has so far. She was as always very helpful and I honestly believe she is doing everything she can. and that the hold up is at the other side

    Welcome to the realms of house purchase.........

    Can't say I'm surprised. Looking at my personal trials and tribulations over the years. There's simply no rhyme or reason to the process.

    if you dont push the process along the way, then there is no one else doing it.

    I dont think your initial time frame was unreasonable, just completed in a similar timeframe on 1st of this month. However we were aware of what was going on weekly, and pushing (together with the vendor) when things got tough going pre exchange.
  • I don't think it was an unrealistic time scale. My property went under offer around 21 May and we are aiming to complete on the 12th August (originally was the 1st August but that was always a bit overly ambitious). However, like you we haven't even exchanged yet although my solicitor and EA both tell me that it's still possible for us to go another week before exchanging and still complete on the 12th. We'll see. We are waiting for answers to queries on my purchase (apparently sent out by vendor's solicitor today so should arrive with my solicitor in a day or 2) and to see if there are further queries from my buyers from their search results and mortgage offer.

    Just to clarify the insurance for you.

    Imagine you are considering taking out health insurance, to cover you if you get cancer. But before taking out the policy, you go to the doctor, who checks you over, and diagnoses cancer. If you now take out the policy, do you think the insurer will pay out.....?

    Now Imagine you are considering taking out Building Regulations insurance, to cover you if you there is no BRs and the council enforces BR certification. But before taking out the policy, you go to the council, who checks their files, and discovers no BRs. If you now take out the policy, do you think the insurer will pay out.....?

    Ah yes that does make sense now, thank you. I read back and no one suggested ringing the council; I'm not sure where I got that daft idea from anyway.

    So I guess we chase up where we can and keep our fingers crossed that everyone else does their bit. Tried to ring the vendor tonight but no answer, have a feeling they are on holiday. Will try again tomorrow

    I must say though that we are in a really fortunate position that we are living totally rent free, in a nice house in a nice area, all our stuff stored in various friends and relatives garages/spare rooms, so really we lose nothing by waiting. We can move any time. I am quite well aware that for some people such delays are quite costly and am grateful we are not in that position. In fact we have nothing to grumble about at all really.

    Will post here when we finally exchange. I am sure you will find it hard to contain your excitement about that, but you will have to try.
