  • Hi, I called the managing agent and requested the contact details which they gave me but categorically state that they are not liable for the actions of the PC and either way feel that they have acted correctly. (No surprise). I have emailed and posted the letter today and will update you. Just 1 question, should I send a copy to the freeholder directed at them or should I send them a copy and explain that I have had cause to send it to the managing agent?

    I would keep your powder dry re the landowner for the moment and see if the letter to the managing agent does the trick.

    If not, then I would copy the landowner into the correspondence with a robust complaint about the managing agents and the parking company, and asking for a copy of the contract that they have with the landowner authorising to pursue owners in this way.

    Just a quick update, other than a snotty email from my contact at the managing agent in response to my request for the name of the md or CEO informing me that they are in no way liable for the actions of their agents, that it is up to me whether I pay or face them in court and that all they have managed to get the PC to agree to is to revert to the original fee of £100 (£20 more than the reduced offer from their debt collectors), the managing agent appears to have decided simply to ignore my complaint. Not sure how long to leave it, whether to follow it up or what to do next?

    Go for the landowner then? Don't ask for the CEO or MD. Just state the position and that the principal is always liable for their agent's actions.

    Sorry, i wasn't that clear. Her response was really rude (will try and post it here) but she did give me the name of a director to complain to and emailed and posted the letter that daisy kindly posted. It's that letter that they have ignored. I'll try and find the landowner details today.

    Yes I did get your message but was rushing off to a meeting so apologies I couldn’t return your call

    I think the evidence shows that a ticket was issued to your vehicle just unfortunate that the ticket was not there in the morning and you never received the two reminder letters send from **** for the payment.

    It is your decision if you want to make the payment of £100 to ***** or to the debt agency for the reduced amount or to take it further to court. I feel I've done what I can to help and now it is something you have to decision what option to take.
