drink driving question?

  • It sounds to me that he knows and refusing to acknowledge it.

He has one easy way of finding out if he was arrested and that is contacting the police and asking them for confirmation and further details of what is to come with regards to court case.

Someone very close to my family got too deep into drink and he too drove and was arrested. His court case was about 3 months after the event. Before the court case, sadly he died. The drink got the better of his body and his organs failed and he died.

He was a heavy drinker, but still held on to his job until a few months to the end and was part of a normal family set up with all the wonderful trappings of a very successful job until near the end.

If ever there was a warning to someone it is this story. Alcoholism is a disease, it needs understanding and a firm hand. It breaks up families and causes untold damage to others through the devastating events following drink driving etc.

I would be getting very firm with this friend and suggest blood tests to check the functioning of his organs and AA. It is a devious condition and the persons word is not always reliable.

Not quite sure what the question is here (are we trying to help the OP work out if the driver is lying, or are we trying to help the driver find out if he (she?) was arrested?) but if the driver doesn't know what happened and the police were involved then surely they just need to ask the police.

Whilst I have sympathy for addicts, I cannot ever understand how a family member or friend would allow that person to endanger others.

Yes, addiction is a personal tragedy, but why risk spreading that pain to others? Getting in a car after having a few drinks is a selfish act and also potentially lethal to innocent parties as well as the drinker.

The OP should report the person every single time she believes he is driving over the limit. No excuse!

Years ago when someone I know's husband was stopped and found to be over the legal limit, it wasn't until it went to court and he was found guilty that a 12 month ban started.

If you are pulled over and found to be above the limit, they won't let you continue your journey I wouldn't have thought. What happens to your vehicle at this point I've no idea.

I'm assuming since he was driving a company vehicle that he is saying his workplace as registered keeper would be informed and that information would filter to his boss?

the company are the owners, he is the registered keeper. or he should be as he is keeping the vehicle.

If you know he's drink driving, why aren't you telling his boss?

because that would be slander, until he is convicted

This thread has made me really angry and I don't want to give any information that might assist a possible offender so I'll keep it bland.

Driving under the influence is an arrestable offence and so anyone testing positive would have been taken into custody for a further test and interviews etc.

An Officer should not allow an individual to continue on his way if he believes him to be a threat to himself or others.

The individual will have been given paperwork at the time... does he have any?

The fact that he can't remember is testament to the fact that he should not be driving - professionally or personally - because of his his head injury and his drink issues.

Anyone that knows someone is driving and presenting a danger to others but doesn't report that fact should be ashamed of themselves.

no-one has disagreed with you. perhaps u just wanted to rant?

Completely agree with other posters, anyone who suspects someone of drink driving should report them to the police ! I reported a customer who was very intoxicated, they have just been banned for 3 years. I would absolutely do it again, the police consider someone who is driving under the influence as an emergency. Anyone who suspects a drink driver should immediately dial 999.

I'd rather take my chances with that than turn a blind eye to someone driving while intoxicated, or otherwise unfit due to a head injury.

u misunderstood. report them to the police, thats perfectly allowed.

if u go on to tell thier boss, then that is where slander comes into it, and u could end up in court

Please can you help resolve a discussion? My friends dd claims he was caught drink driving, and was held in cells overnight he denies it, saying pointing out several things 1, his works vehicle would have been impounded and his boss informed, 2, he wouldn't have been able to send a text after being pulled over as they would have taken his phone immediately. 3, he would have had an immediate ban. I know he was driving after drinking and I'm having real issues with it but I'm really hoping he's telling the truth but puzzled as to why his dd would lie?

The OP raised some procedural questions and also indicated that s/he was aware that this friend did drive after drinking but apparently does nothing to report it...

I responded to those issues giving generic responses regarding process following testing positive. I also said it made me angry that someone (the OP) might know someone is driving under the influence yet not reporting it.

I didn't suggest anyone had disagreed with me - my points were directed at the OP and no-one else.

That is not a rant - it is a response.
