drink driving question?

Please can you help resolve a discussion? My friends dd claims he was caught drink driving, and was held in cells overnight he denies it, saying pointing out several things 1, his works vehicle would have been impounded and his boss informed, 2, he wouldn't have been able to send a text after being pulled over as they would have taken his phone immediately. 3, he would have had an immediate ban. I know he was driving after drinking and I'm having real issues with it but I'm really hoping he's telling the truth but puzzled as to why his dd would lie?

    He is allowed to drive until convicted...And if the van/car is in order there is no reason to take it..They do not take it for d&d...Why would they inform his boss unless he is in a reportable job like a doctor, police.

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
  • He's saying if he had been pulled for drink driving they would have immediately impounded the company van he was driving and therefore notified the owner of the van? I have concerns as to what the truth is as he doesn't remember the evening in question or even much of the next day but thinks he slept in the van, as it was over a week ago I'm presuming he would have heard something by now? I do actually believe he doesn't remember as he has just been diagnosed with post concussion syndrome following a head injury and is struggling with his memory generally at the moment.

    Was your friend arrested for anything when this happened? If so then there is a good chance that he was taken in for the charge. If they didn't take him in then chances are he wasn't charged with anything. Drink driving is a serious offense with no tolerance, so there's now way they would have turned their cheek to it.
  • He doesn't remember anything till sometime after arriving home the following afternoon, so its possible that he was arrested, I don't know, I guess it will be a case of waiting to see if he gets called to court.

    And how does that impact upon his driving for the company :( (never mind being on the sauce)

    Legal requirements
    If you have had a brain injury that could affect your fitness to drive, you must inform the Drivers Medical Unit of the DVLA (Driver and Vehicle Licensing Authority), and your insurance company. If you are unsure, your doctor will have access to the rules and will be able to advise you.
    It is the driver's responsibility to inform the DVLA. Failure to do so is a criminal offence and could invalidate your insurance.

    This doesn't detract from the drink driving aspect though.

    LOL, is that how justice works in this country, think it through logically. Where's the court order? Where's the trial?

    No his vehicle would not be impounded. No his phone would be in his possession until he got to custody. His boss would defeintely not be told. And hes allowed to drive until such a time that he is convicted and banned.

    Years ago when someone I know's husband was stopped and found to be over the legal limit, it wasn't until it went to court and he was found guilty that a 12 month ban started.

    If you are pulled over and found to be above the limit, they won't let you continue your journey I wouldn't have thought. What happens to your vehicle at this point I've no idea.

    I'm assuming since he was driving a company vehicle that he is saying his workplace as registered keeper would be informed and that information would filter to his boss?

    This thread has made me really angry and I don't want to give any information that might assist a possible offender so I'll keep it bland.

    Driving under the influence is an arrestable offence and so anyone testing positive would have been taken into custody for a further test and interviews etc.

    An Officer should not allow an individual to continue on his way if he believes him to be a threat to himself or others.

    The individual will have been given paperwork at the time... does he have any?

    The fact that he can't remember is testament to the fact that he should not be driving - professionally or personally - because of his his head injury and his drink issues.

    Anyone that knows someone is driving and presenting a danger to others but doesn't report that fact should be ashamed of themselves.
