I received a 'Parking Charge Notice' recently while out shopping in a retail park.
The alleged reason for issue was I was in a Disabled Bay with no badge displayed. As far as I'm aware I was parked in the non disabled bay next to the disable bay.
I only noticed this 'Charge' when I got home, so couldn't check.
What do I do?
Ignore
Pay
Appeal
Is this a legitimate company?
The bit about POPLA confuses me, could I actually be taken to court?
Thank you
I am not sure how, by repeating the information that we have provided endlessly on other threads, it is going to be any clearer this time.
Each thread advises not to pay.
UKCPS is mentioned time and time again - just search.
Yes, ultimately if you do nothing or the wrong thing, you could end up in court.
What do you do? Read a few threads and then come back with some specific points you need clarification on.
But if you want us to put a bit of effort in to helping you, put a bit in yourself first.0 -

Pointless doing a soft appeal to UKCPS as you won't get a POPLA code. And you can't email them either despite what the fake PCN might say!

and here's a thread showing a strong appeal (DO NOT JUST COPY IT VERBATIM!) which caused UKCPS to just give up before POPLA:

So as far as I'm aware this isn't a 'demand' for money, I'm under no legal obligation to pay them anything?
Correct. PPCs argue that you have a contractual - not legal - obligation to pay their invoices.- Firstly what evidence do they have that I parked in a disabled bay? As far as I'm aware I was parked 'next' to a bay not in one.
They may have either a camera on the premises or parking attendants on duty who may have observed you doing this. Regardless, this is but one of many challenges facing PPCs in making people pay them.- Secondly if 'Blue disabled badges' are not valid on private land, then what right does this company have to tell me I'm not allowed to park in a bay without a 'blue badge' that isn't valid in a private car park in the first place?
They can make all kinds of terms for parking in their land but the fact remains that unless you knowingly entered a contract with them then they have no grounds for enforcing them on you. There are signs, which I only noticed while re-visiting the retail park, there was only 2 that I noticed, one a walking distance away and another one a pole on the opposite side of the car park (both not visible from where I parked.) It stated that by Parking in the car park I agree by the companies terms and conditions, but how could I have agreed with them firstly by not seeing them to read?
Precisely. You should also consult the BPA's regulations about signage to see if the company's signs violate any of them. In many cases they do.It looks as if I have to first do a 'soft' appeal first, It states that appeals should be made within 7 days after which I have to write to POPLA.
Read the sticky threads at the top of the page for information about POPLA appeals. You will need to receive a code from the PPC.0
