The consumer needs to demonstrate an inherent fault only if the supplier disputes the cause of the defect. This has not happened.NFH' s advice is well meaning but not completely correct. In order to exert your rights under either the SOGA or SOG&S then you need to show that there is an inherent fault which had caused the handset to stop functioning. (And also see my earlier post)
Vodafone appears to have disputed that it has any responsibility to the consumer after the warranty has expired (oblivious to the Supply of Goods and Services Act 1982) rather than disputing an inherent defect.In your situation, it looks like Vodafone have rejected your claim and so you will need to produce some sort of proof of your opinion. It's unlikely that anecdotal evidence from the Internet is going to be enough, unless you can find an acknowledgement by Apple, Vodafone or credible third party that this is an inherent issue.0 -
Vodafone have finally given in a sent the phone off repair free of charge.
