quote the law. 2 year warrenties are not uncommon. and if i buy a car i expect to run it for atleast 2 years! thats reasonable.
but agreed, the dealer needed to be allowed to investigate
If you buy a used car from a normal dealer, expecting them to repair under SOGA for 2 years is probably a bit much - a lot of wear and tear can happen in 2 years.
A warranty is different to your rights.0 -

Yes it does. They could / will argue that they should have been given the opportunity to inspect the vehicle first.
I think you might have torpedoed your claim against them actually by doing this.
Contact trading standards and see what they say. It will be an uphill struggle though.
Sorry.
Okay, thanks for that. I'll probably just put this one down to experience then:)
Just as a warning to anyone else who finds themselves in the same boat though, if you buy a car and it develops a major fault, DON'T take it to another garage, even if in my case, that's what they suggest. If you can afford to, hang tight and either insist they come and get it or have it trailered back to the dealer not forgetting to give them back all the keys and paperwork. I'm lucky that they did at least pay something and I'm also VAT registered so I'm going to be a maximum £300 worse off so I'm counting my blessings it wasn't worse.
Thanks for everyone's input on this, I'm truly grateful0 -
Never in a million years is a dealer expected to stand over any car for two years.
Also, they *had* a claim, however they've now taken it to another mechanic to fix, so they've pretty much scuppered their claim against the dealer.
I agree that two years is a bit long for a SoG claim on a pre-loved car, the only case I can think of is where a latent manufacturing defect (like VAG injectors) but then the manufacturer normally steps in (as VAG have done)
Taking it back to the seller if possible is a good idea but as they instructed the OP to take it somewhere local then I don't see how it diminishes the OP's claim in any way.
OP......I'd say you should be able to reclaim the full cost from the seller, obviously as you are VAT registered then you shouldn't claim the VAT portion from HMRC rather than the dealer0 -
