What do people think of chance of legal action being successful?
Flight booked from Birmingham to Kuwait with a connection in Dubai. Landing in Dubai had 1.5 hours to go through security etc and get to new flight. Flight delayed 1 hour from Birmingham meaning missed connection to Kuwait. Given hotel room for night and put on the next flight to Kuwait about 6 hours later.
Sent email to Emirates who say:
Please be advised that compensation in accordance with EU261/2004 only applies for flight delays of more than 3 hours.
As the arrival of flight EK040 from Birmingham to Dubai was less than three hours late, EU compensation does not apply. Flight EK853 from Dubai to Kuwait is not governed by EU legislation.
The way I understand this that is not the case and has arrived in Kuwait over 3 hours late am entitled to compensation.
Don't want to waste money and/or time on legal if no chance

Did you have a through air ticket from BHX to Kuwait with a single ticket number, if so that was your ticket and the stop in DXB is irrelevant.Posts are not advice and must not be relied upon.0

The booking was BHX to KWI. The ticket was an e-ticket and showed it has two items detailing each flight. So the first line was BHX-DXB and second line DXB-KWI0
