My partner was recently in a IVA,
he recieved a letter from his IVA and underneath was this man David Sharp, with his phone number and basically saying if you would like to discuss your IVA contact me blah blah the usual stuff from letters you can get.

My partner has decided to come out of his IVA and become bankrupt...hes started making payments towards court dates and so forth i was just wondering if this man is legit? Does anyone know because i was concerned before and now im still concerned...im worried he might be dodgy and lordy lord that wont be good!!!!

How long has your partner been in his IVA?

This company basically trawl the insolvency register and then contact people in an attempt to "help" them go bankrupt, usually persuading them not to pay the IVA and to pay them instead for bankruptcy assist and bankruptcy fees.

How much is your partner paying them?

Hes paying 170 a month, has been for the past 4-5 months.

Using any such company, even if legit (which is doubtful), is just pouring more money down the drain and encouraging these bottom feeders.

If he thinks bankruptcy is a better option for him, is there a reason he didnt go bankrupt at the time instead of going into an IVA?

Does he have any assets at risk in a bankruptcy?

If he has decided bankruptcy is a better option, he could let the IVA fail and on termination declare himself bankrupt.

His IVA has already been terminated, hes not in it anymore, this man made that happen with letters and what not which my partner signed.

He doesnt have any assests at risk, he wasnt aware he could go bankrupt at the time and was told by someone completely different that an IVA was a good option for him...but then found out that the IVA advisors get so much money for each person the sign on a what not so he assumed the advisor only told him to get an IVA for that reason.

I suspect they will use his IVA paperwork to complete the SOA for the bankruptcy, I've seen these myself in the past, including ones which were copied word for word

So it is possible he is going bankrupt and this man isnt a con man?

Ive got no doubt he will help him go bankrupt but at what cost?? he can do that himself with the help from this board for free :-)
