I have recently taken out a contrat with Virgin Mobile via CPW's online arm, OneStopPhoneShop. Before taking out the contract I rang Virgin tio enquire about data charges as this is important to me, i was told by a Virgin representative that the cost was 1/2p per Megabyte and that there are no data packages available. I deemed this cost to be acceptable and duly signed up.
On recieving my 2nd bill I was horrified to see that I had racked up £26 in data charges alone, when I queries this I was told that the cost is actually 1/2p per KILOByte and therefore 10x the amount I was told.
I rang Virgin and they said that since they had no record of my call (it was prior to my contract and from a land line at work) that they were unable to verify the information given and the best they could do was offer me a £10 refund which I find derisory.
I have also spoken to CPW and they say that since it was Virgin that gave me the info it's not their problem and that my as contract is directly with Virgin I should take it up with them.
The upshot is I now have a phone which is no good to me at all and 16 months of a contract remaining. my existing provider is Orange who can offer me the required package and as a gesture of goodwill will credit my account with £100.
The question is, do I have any chance of getting Virgin to cancel the contract on the basis that they gave me duff information, or do I put it down to exerience?

you could argue that the you were misrepresented the contract. See http://en.wikipedia.org/wiki/Misrepresentation for some brief information on misrep, basically you believe you were induced into the contract whilst wholly relying on the information provided. Could argue for the contract to be rescinded at the least. But to be honest you would have to cause a lot of grief to them for them to agree!SLC: £13000+

Agree with diamonds, put it down to experience.
If its a decent handset, you could try to sell it without the sim on ebay to try and offset the cost of the contract.
Not sure what the demand is for a virgin handset that's locked to the virgin network though :rolleyes:

I thought as much, I might try a letter suggesting that they misrepresented the contract and see if I get a response, otherwise its another lesson learned and back to Orange I guess.

Virgin will send the unlock code free if you've spent more than £30 on calls/data (which OP evidently has) so that will at least make it a bit more saleable

Thats stupid! ALL datacharges are always quoted in MEGABYTES. Why does virgin have to be the odd one out???? I would try and geti it cancelled. #
If you know the number you rang from and the date they should have the phone record. If they cannot prove it then it is your word against theirs...........
