Airline Passenger Lists

Just started a claim with Thomas cook and they keep asking for proof of flying. I have the original flight ticket from a tour company and the luggage tags from the outbound flight but nothing for the inbound flight that had the delay. Do airlines not have to keep record of who flew and when? Does anyone know how to get around this one please?

    Easy.

Make a Data Protection Act Subject Access Request asking specifically if your name appears on the Passenger Name Record for the flight concerned. They must reply within 28 days.

Sorry.... but I presume I do this direct to Thomas Cook and not to any other ruling body? Am I right in thinking that they do have a statutory right to keep records?

    Google SAR Mike.
But yes you apply to TC for the info. Sainsburys won't keep any records of the passengers ;) nor will anyone else :D

Statutory right? Well I don't know for certain. But there must be some onus on records just from VAT purposes. Let alone the terrorism angle.

    A few other thoughts here....

Go straight to a 'notice before action' threatening court action. I had no 'proof' I was on the flight (boarding card, 'ticket', luggage labels), but they did not dispute that once I had sent an NBA

Perhaps contact the agent you mentioned and see if they can provide a copy of your details. Might need to be persistent. his has worked for a few people.
