I've just received the answer to my appeal to the parking charge levied at Shrub Hill Retail Park. Euro Car Parks have stated they have appropriate signs and that they don't charge penalty's [sic].

Therefore unless I pay the £40 promptly they will put debt collectors on to me or take county court action. If I appeal to POPLA and lose then the charge will be £70.

I can't take the risk of county court action and it seems the only option is to pay!

(And make sure my son does not park in that car park again).

Errr ..... really ????? Firstly why can't you risk a court action ? You would win !

Secondly why would you even think of paying when you haven't even made the effort to appeal to POPLA ?

Post #4 says they have no planning permission to bring in these charges.
That means they are acting unlawfully.

Did they give you a POPLA code?

    If so, use it.

If not, then demand the code telling them that they do not have a planning consent, that you will be producing the original consent and will be requiring them to produce the amendment for POPLA's inspection. In fact, even if they have issued a code, tell them that anyway.

If they do not want that to happen, then they should cancel your charge.

In John McEnroe's immortal words 'You cannot be serious'! In my (less) immortal words '!!!!!! man, you can win this easily!'

Debt collectors can only chase debts. In your case who has determined there is a debt - have you informed them that you accept you are indebted to them?

Get that POPLA code and get your weapon ready for shooting fish in a barrel (with forum help - don't go it alone to POPLA).

Keep the scammers at bay :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You were JOKING with this post, right?

You appealed (stage one) where you were never going to get it accepted and just use it to get a nice POPLA code. Simple, a 'stepping-stone' stage only.

And now you go that expected rejection letter and precious POPLA code and are at stage two where forum-assisted POPLA appeals win 100% of the time...but no, you've decided to pay the scammer instead of beating them with one simple copy & paste POPLA appeal letter.

OK. Each to their own, a fool and his money and all that, but a terrible example of 'scam-victim mode, let's just pay a scammer' for your son! :p
