ebay advert misleading, what would you expect from this?

Hi All,

I am after some views. If you read this description, what would you be expecting to receive? especially this line

"THE PHONE COMES WITH NEW SYNC DATA CABLE CHARGER , GENUINE PLUG, GENUINE BOX"

HELLO I AM SELLING TODAY IS AN APPLE I PHONE 5 16GB in white & SILVER 16 GIG ***BRAND NEW***
on
T-MOBILE +ORANGE + VIRGIN ALSO KNOWN AS EE.....


THE PHONE IS ONLY 5 DAYS OLD NEVER BEEN USED.....SO STILL WAS APPLE WARRANTY
TILL ********24TH JUNE 2014***** MORE THAN 11 MONTHS WARRANTY!!!!!

THE PHONE COMES WITH NEW SYNC DATA CABLE CHARGER , GENUINE PLUG, GENUINE BOX
MANUAL & SIM CARD EJECTOR PIN...... NO EAR PHONES....


THE PHONE IS GENUINE NOT ON CONTRACT SO WILL NOT GET BLOCKED...
100%GENUINE..... SO BUY WITH CONFIDENCE...


ALSO SOFTWARE BEEN UPDATED TO LATEST... I.O.S 6.1.3


STILL HAS THE GENUINE STICKERS ON FRONT & BACK....
THE PHONE IS BRAND NEW....


From the description of it all I expected a brand new phone with brand new accessories and genuine parts including the apple usb cable. I have just found out that the cable is not a genuine cable but one bought from ebay at £1.40, it is now falling apart. The ad is very misleading and it is not clear that it doesn not have genuine parts. Am I correct to assume this? I am sure there is a lawa against misleading adverts. I am fuming :mad:

    All I see from the ad is that the cable is 'new' not 'genuine'. The description seems to be accurate. Seeing the description is correct and this is only a matter of a cable (assuming a good one won't cot that much more) can't you just put it up to not reading things clearly enough on eBay?

    I did a similar thing 10 years ago on eBay, I read the add & technically it was correct. This is very similar. You just need to be very vigilant if you intend to buy normally expensive items cheap from eBay!!

    Edit to say I've just checked and can also work out your eBay ID & see you've already left the seller positive feedback.

    This appears to be the item.

    Another tip, when you spend £390 leave it a bit before leaving positive feedback, that'll give you a bit more bargaining power if you're not happy.

    The ad says the box and plug are genuine, the sync cable is new, not genuine. Was the cable new, as in the ad, or used?

    It sounds like they've kept the genuine sync cable themselves and swapped it for a generic one.

    under the marketing and advertising law, it states

    The Consumer Protection from Unfair Trading Regulations means you can’t mislead or harass consumers by, for example:
    • including false or deceptive messages
    • leaving out important information
    • using aggressive sales techniques
    especially the deceptive messages and leaving out important information part, to me this is misleading and leaving important information out is definitely there. I would not have bought it had I known it didnt have all genuine parts, also the genuine word plastered everywhere is misleading. Oh and it wasnt cheap either

    Hi MoneySavingKing,

    Yeah lesson learnt about feedback, I was a bit vague about it as I only gave feedback on the phone, and only noticed yesterday that the usb cable was falling apart. I was trying to be a good buyer and leave feedback in good time. Well lets see what the outcome of ebay resolution is. As you can see its not about the money, I bough this phone for my 14 year old son, its the principle, if you say genuine all over your ad I expect it to be genuine. I am a consumer and dont appreciate being deceived

    It clearly says genuine plug, genuine box but leaves out the geuine part on the data cable, technically the ad is correct.

    For a cable it's not worth the hassle, just getting the phone is a plus these days on Ebay.

    Was the person you bought the phone from a business trader or a private seller? as the regulations you quote only apply to businesss.

    I think he is a business as he has a few other phones for sale, I cant imagine an idividual would have a few iphones for sale and other accessories

    The ad is technically correct, but very misleading.

    Actually, I've changed my mind, as the 11 month warrenty and brand new status would mean that all parts should be genuine.

    I would email them and say the cable is faulty but Apple won't change it under warranty as it isn't genuine, so as they seem to have sent the wrong part, would they please send thd genuine one ASAP.

    I emailed him telling that the cable was falling apart and I was going to take it to apple but I just wanted to confirm that it was genuine. His reply was, "apple won't be able to do anything as it is not a genuine cable, I can refund £1.40 as that is how much they are on eBay where I got it from, those cables are not ver good them"

    Those were his word, I am so angry, had I known any of it was fake I wouldn't have made the purchase
