Aircraft problems on previous flight causing a delay

Hi, I've read dozens of times that if an aircraft "goes tech" before your flight actually begins (i.e. it "goes tech" on an incoming flight but was planned to be used to operate the outgoing flight as well) then it can't be used as a defence against compensation.

Does anyone have a link to a court ruling etc. that specifically states that? I've been searching for hours but can't find it mentioned anywhere! And would this still apply if the tech problem was caused by "extraordinary circumstances"?

No. That is not the legal test at all. There is no legal ruling that specifies this. The closest in the Finnair judgement, but that relates to denied boarding, rather than delay/compensation.

This has been discussed extensively on this forum, including by me today. You need to do some searches/more reading.
