We were on our way to Tenerife September 2012 and our Co Pilot was taken ill we diverted to Portugal there wasn't another Pilot available we stayed overnight finally reached our destination 19 hours and 42 minutes late. I have checked out other posts and wondered if anyone has had any luck in claiming compensation yet? I have recently received a letter back from Thompson stating an "exceptional circumstance" and just about to fill in the CAA complaints form. It would be nice to hear from anyone that has had a successful claim for this flight as this would then at least give me some hope.. Thanks

No, no, no. The CAA is not the way to go. A pilot illness is not extraordinary. And it shouldn't cause a 20 hour delay. See here for next steps:

Hi Vauban, thanks for your response. I'm unsure what a NBA form is and where to obtain one from. Without knowing what one is I don't think I can make a decision about what to do next. Can you possibly point me in the right direction? Thank you0

Hi Vauban, sorry about the delay in replying again i'm new at this so please be patient with me. I now know the NBA (notice before action) so will look into this course of action, so thanks for the advise. The pilot was ill so we diverted to Lisbon. He had a stomach upset, and whilst i fully understand the Health & Safety legislation requires that they make an emergency landing I am also aware that the airline must have a duty of care to the customers. As Thompson do not operate from Lisbon, we had to wait for another pilot to be flown in on another charter plane (unsure which Co). The Pilot however was not hospitalized on the contrary he was given medical assistance in the aircraft and hopped into the BLACK Mercedes and taken along with the cabin crew to the hotel to wait for our arrival 3 hours later! I was hoping that some of the other passengers might have made a claim/ court action. I have located one other on here that you or Centipede?? has responded to but unsure whether to make contact or go it alone?Thanks again for taking an interest. :A0
