Really?
Do explain - as a supporter of Scotland's decriminalised parking initiative (where valid enforcement of misusing BB bays on private land will incur legally enforceable) the issue of space unavailability for BB users is addressed - but not by parking anywhere they like.
For good measure, Glasgow is now getting green bays (for the exclusive use of electric vehicles whilst charging. BB users are NOT exempt should they use these bays and will be ticketed. It may come as a shock to those who believe they have the equivalent of a 'golden parking permit' but hey, it's not my problem.
Lastly, perhaps if you read my post a little closer, you would have spotted that at this hospital ALL parking is free of charge. Your ignorance of the matter is breathtaking.0 -
But is isn't that enforced on private land by council CEOs ? And as there was no abuse in this case it's not really relevant. As I said previously this fake ticket should be ignored. And that doesn't mean I endorse what was doneWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

EQUALITY ACT 2010
142 Unenforceable terms
(1) A term of a contract is unenforceable against a person in so far as it constitutes, promotes or provides for treatment of that or another person that is of a description prohibited by this Act.
144(1) A term of a contract is unenforceable by a person in whose favour it would operate in so far as it purports to exclude or limit a provision of or made under this Act.
29 Provision of services
(1) A person (a “service-provider”) concerned with the provision of a service to the public or a section of the public (for payment or not) must not discriminate against a person requiring the service by not providing the person with the service.
(2) A service-provider (A) must not, in providing the service, discriminate against a person (B)—
(a)as to the terms on which A provides the service to B;
(b)by terminating the provision of the service to B;
©by subjecting B to any other detriment.
(3) A service-provider must not, in relation to the provision of the service, harass—
(a)a person requiring the service, or
(b)a person to whom the service-provider provides the service.
(4) A service-provider must not victimise a person requiring the service by not providing the person with the service.
(5) A service-provider (A) must not, in providing the service, victimise a person (B)—
(a)as to the terms on which A provides the service to B;
That is the position in a private car park where there is no Parking Places Order and no Council involvement (Blue Badges not applicable despite the scammers' signs). The Equality Act is silent on 'Permits and Badges', as they are not the only indicator of disability need by a service-user wishing to avail themselves of a 'reasonable adjustment' provision such as a wider/closer bay. It would be different in a car park where the statutory effect of the Blue Badge scheme applied due to an Order being created so that Council CEOs could enforce (as is indeed possible in Scotland).Lastly, perhaps if you read my post a little closer, you would have spotted that at this hospital ALL parking is free of charge. Your ignorance of the matter is breathtaking.
What has that point 'free of charge' got to do with anything?
The discrimination is in the harassment and direct discrimination involved in the issuing of a fake PCN to a blue badge holder who needs the reasonable adjustment of a bay near the Hospital, not whether or not it's P&D or free.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Balderdash! - Do go and acquaint yourself with the correct position before coming here and spouting drivel!
1 - Disabled Bays on private land in Scotland do not generally attract any kind of legal enforcement. For legal tickets to be issued under Scotland's DPPPA, the landowner needs to apply for a TRO to the local council on an individual basis, bring their bay markings and signage up to TSRGD-Scotland standard and negotiate wayleave for council patrollers to come on to the property to issue proper council tickets.
The instances of this actually happening are very few and far between - and the vast majority of DPPPA-compliant TROS have only been issued in the private residential context.
2 - Not all Scottish hospital parking is free. PFI hospitals were exempted from the bar on charging so can continue charging as before - At least part of the Gartnavel site is covered by a PFI scheme.
So please stop trying to mislead. The OP has a ticket from CP plus, a well-known shonky operator, we can pretty safely assume that neither the BB regs, nor the DPPPA applies here and its the Equality Act Scotland that the OP needs to concern themselves with.
And what on earth have "Green Bays" got to do with anything - Again, they have nothing to do with this context0 -
After a slightly disgruntled e-mail fired off to Glasgow NHS Trust,they're gonna investigate and get back to me.
Sounds promising.:)Quis custodiet ipsos custodes?0 -
Sorry for taking a while to get back this-eventually-after receiving a bit of a rambling letter which skirted the issue of my brother being wheelchair bound and not being able to drop him off then go find a parking space-they decided to waive the fine as a "goodwill gesture"Quis custodiet ipsos custodes?0

That's a good ending then. :beer:
It being called a 'goodwill gesture' is about as near to an apology as you'll get from those greedy scoundrels.
Thanks for coming back and letting us know.0
