Fake PCN from non-BPA approved operator

A colleague at work has just received a fake PCN from an outfit called Car Care Services - I have checked the BPA website and they are not on the list of approved operators.
They also do not have the BPA logo on their website, but they do claim the following under their "enforcement" section:
"We use details from the DVLA to enforce our systems making sure we apply the correct information to you and the clients. We regularly monitor the information keeping up to date with all changes and patterns."
Clearly if they are getting DVLA info it would not be lawful under these circumstances, would it?
I have advised the colleague to wait for the Notice to Keeper, but this outfit should not be accessing that info - should he still wait for a NTK
under these circumstances? And if it arrives, report them to the DVLA for accessing the info? Obviously no POPLA code will arrive either, so what would advice be under these circumstances?
He had paid for an hour parking but overstayed, circumstances prob not relevant, out of his control.

You have made the mistake of assuming that these bozos are telling the truth about the DVLA. They are in fact (to use the technical term) lying.
We had another one a few weeks ago claiming they would access DVLA details. I complained to DVLA about them, and the DVLA responded that those cowboys had never requested or received data, that DVLA was aware of the claims on their website, and that the matter was in hand.
Lo and behold, all references to DVLA have now disappeared from their website.
Your colleague should ignore CCS, but I would encourage him to complain to DVLA about these cowboy operators and their misrepresentation.Je suis Charlie.0 -

Show your friend and give him this email addy for the DVLA complaint:

He should also send a complaint in writing to the local Council Trading Standards Officer (do not attempt to contact TS by phone as you get a central consumer fob-off 'helpline' and get nowhere re local issues at all). Just write a complaint as a formal letter with as much detail as possible about the car park and operator, and address it to 'Trading Standards Dept' at the nearest Council main offices to the car park. Make it clear the complaint is about lies on the company's website (may be best to get a reply from the DVLA first confirming that this firm cannot even get DVLA data, that would help the local TS to understand an issue they may not be familiar with).
