Good morning
So my husband has received a parking fine from Ace Security. I have checked BPA website and they are not listed. So am I right in thinking we do not have to pay as it is unenforceable?
Thanks for your help

They are all unenforceable, but the particularly good news about non-BPA members is that they are not permitted to access the DVLA database hence they have no way of finding out your husband's name and address! So ignore them with impunity 'cos they've no idea who you are!
Is it these clowns? http://www.acesecurities.co.uk/
However, it is not unheard of for these companies to get a member company to access the DVLA database for them, which is illegal - so if your husband does receive anything in the mail from these jokers please let us know and we'll tell you how to get a lot of people into serious trouble!Je suis Charlie.0 -
Thanks. Yes that is them!
They claim to have access to the DVLA on the ticket.
The words on their website are horrible. I wish my husband would be more careful where he parked - I am telling him to speak to his client.Gc challenge £363.53/ 500

It says so on their website too, although there is no BPA or AOS (Approved Operator Scheme) logo. Do such logos appear on the ticket?
Sounds like blatant misrepresentation to me, which would be a CRIME!!! You MUST report this to Trading Standards and ask that the company be investigated for misrepresentation.Je suis Charlie.0 -
Also file a complaint to the dvla as well
foi@dvla.gsi.gov.uk
Ask them how a non BPA AOS member can access the DVLA database, and how they are going to ensure that data is not released to a non ATA member over this. Any release would be a breach of the DPA as they are a parking company and not the landowner. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I presume DVLA should have records of who they released the information to....so should know which company is passing that info on in an unregulated manner :-)0 -

Yes ignore the parking company, but not the fact that they have lies on their website. The dvla should be notified as a matter of course, its a perfectly reasonable course of action if a company doesn't appear to be an approved operator, but says they will access their database to get RK detailsWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. Whether they have obtained RK details from DVLA or not, it still looks like misrepresentation, which would be a criminal offence.
I have emailed DVLA.
I'm guessing we're dealing with a knuckle-dragging former clampit, it's the kind of dumb thing they would do.Je suis Charlie.0 -
Yep, ex-clamp gorillas. They have featured on Pepipoo in the past.Je suis Charlie.0

Ah apologies - misread - my bad
I see the post just says that the ticket mentions DVLA - I thought it was the paperwork.
Too early in the morning for me I think :embarasse0
