court proceedings who are you going sue when i dont know where they are, it would be just wasting money with court proceedings.
No-one can end a tenancy other than the tenant or a court. You are neither of these, so you need to follow the correct processes for the court to end the tenancy. Good luck.0 -
i dont think some people understand she has trashed my house, stolen stuff from my house, knowing her shes probably left 2 months ago and gave keys to someone else because theirs letters and other things from other people.
people keep harping on about law but i dont know where she is, shes vacated the property letters will not be received by her because shes nowhere to be seen. court proceedings who are you going sue when i dont know where they are, it would be just wasting money with court proceedings. the law just protects tenants but if theyre skum then the landlord is still at fault.
iv changed th locks about a week ago and guess what ive not received a call saying why have you changed the locks.
If you had looked into being a landlord properly you would know that the only people who can end a tenancy are tenants or the court, you would also then know that the court could present to her (e.g. her rental address) which gives her an opportunity to respond, or it would if you hadn't changed the locks. After a failure to respond the courts could end the tenancy in her absence. Until this happens she is legally the tenant and therefore you cannot rent to someone else.
The law does not just protect the tenant, if you had acted legally by doing things such as protecting the deposit, not entering her home without permission, not changing the locks on her home and not repossessing her home you would have had a very quick and simple case at court to end the tenancy once you realised she had vanished. As it stands when you go to the court and attempt to end the tenancy you could get in a very sticky situation as they will want to see absolutely everything, including proof of a protected deposit.
If you had acted within the law you could have claimed on your landlords insurance for your losses, but as you chose not to do things such as protect the deposit you will have to pay for everything out of your own pocket.0 -
You kind of want the OP's posts and situation to be put as a sticky at the top of this section as a What not to do as a Landlord 101!! A perfect example of someone going into being a Landlord and not researching all of the information they need to know, most probably because of the feeling that "oh its fine I have an Agent, they will handle everything and know what their doing so I can leave it upto them!!".0

i think all you people who are responding must be tenants, all i can say about my pathetic ex tenant what comes around goes around0 -

You are obviously still under the impression that the fact the house has been trashed is relevant. What is relevant is that you have broken the law by not evicting her properly.
Whether she is there or not you have to follow the procedure and until you do, that house belongs to the tenant, whether they are there or not.

The tenants actions are not ok, however,
You had an opportunity to protect yourself against her stealing your things by registering the deposit.
You had an oppotunity to protect yourself from the rent arrears by following all the advice in previous threads on how to evict a tenant properly.
You ignored all of this and went on to commit several criminal acts yourself.
You also seem utterly unable to grasp the fact that court papers need only be served on her last known address, i.e. the rental property. If she does not respond, and the case is found in your favour, she recieves the judgement in her name anyway. It would have caught up with her eventually.
However you changed the locks (which at present, she is entirely legally entitled to turn up and remove) so she will simply prove she was unable to gain access to the property to recieve the court papers and defend herself.
Unless you are prepared to set out the information requested in Yorkie1's post on 18th July, WE CANNOT HELP YOU.0 -
