If there are conflicting stories and no witnesses no-one knows who is telling the truth. Hence some end up as split liability.

But you say the damage will confirm the way this happened??
Yes It happened exactly as I described so damage will match up.

Just spoke to my insurers, they spoke to her and she admits pulling out on me, said it was a blind spot so she didn't see me, but also said I was speeding (I wish my car was powerful enough to be able to speed up a steep hill, barely 50 yards from when I turned into it) Insurers said that if she didn't see me, how would she know I was speeding.
Anyway, they are proceeding as if it's not my fault so I guess I will just see what happens. No point stressing over it, it's done now, I just hope the woman who helped me saw and can be a witness.

I wouldn't worry about the speeding bit. Its largely irrelevant and she can't prove it. As you say, how does she know you were speeding if she didn't see you.
  • Just an update. 3rd party has accepted liability, I got offered £350 and got £80 scrap value for my car.
Not bad seeing as I only give £300 for it.

Nope lol They are still the biggest crooks going, it's just nice to be 'up' for once.

enjoy it, the industry will likely get the £350 (and some) back as non fault loadings over the next 5 years.

Run some dummy quotes to see what sort of effect it will have and claim it back as an uninsured loss off the at fault insurer.

and check to make sure your insurer is one that lets you transfer the remaining 11 months cover to a replacement car.

Some will end the policy (but you still have to pay the full premium) on a total loss payout.

If yours does end it then that is another uninsured loss to add to the claim

Yep that's why I say they are crooks.
They let me carry on the policy when my car was stolen a few months ago and said I can put another car on the policy.

    I don't think I will bother, don't have much luck :o
