O2 iPhone insurance

Hi guys,

Posting on behalf of the boyfriend who is driving me crazy whining about it.

He has an iPhone 4S on contract with O2 with the greyed pit wifi issue.

He's about 14 months into his contrary so his warranty is up (he did send it away for repair a couple of months with a different issue and a refurbished one was returned, but presuming the warranty is the same).

O2 are saying because it is a manufacturers fault it isn't covered by the insurance policy so a claim is likely to be rejected, so it would have to be send away as an put of warranty repair costing £139.

Has anyone else had a similar issue with O2? He's tempted just to smash it and make an insurance claim that way but it seems a bit risky as undoubtably they have notes on his account about ringing previously?

And help would be majorly appreciated :)

    Ask them to prove via an engineers report that this is a manufacturing defect which was likely present when you bought the phone, then use this report along with the sale of goods act to have the phone repaired by Apple. If apple send you a report saying it isn't a defect, take that report back to the insurance company and ask for a repair/replacement or you will take them to the small claims court or obmisman.

    He tried to go back to the store today but it was closed (typical). We're just bit concerned that sending it to the engineers as an out of warranty phone will charge him regardless, then its going to be a case of disputing this which no doubt won't be easy.

    Does the sale of goods act apply as the phone and replacement worked at point of sale? Plus it works for calls/texts/3g, just not wifi, so its more arguably fit for its intended purpose?

    Sorry for rambling! I've passed on your advice. We're digging out his insurance paperwork tonight ready to arm ourselves against their customer services tomorrow morning.

    Insurances normally don't cover faults.

    This issue has been going on randomly across iPads and iPhones for over a year now with no explanation and no fix. Undoubtedly Apple will be aware of the issue. Even if a fix was available I would expect it to be bundled into iOS 7 as a software update and it's unlikely it would be before. There is still a chance that iOS7 may do absolutely nothing to fix it either.

    I would personally try everything on this if it hasn't been tried yet then either chase up O2/Apple or wait for iOS7. The link above seems to refer you to Apple on this one but the standard process is to contact O2.

    One point I am confused about when digging into O2's insurance documents online is an exclusion listed below:

    14. Cost if repair or replacement where covered by the manufacturers guarantee or warranty.

    I may be totally wrong but Apple provide a 12 month warranty and the OP has not paid for an extension. If the OP has had this phone for over 12 months am I not right in saying that fixing this would no longer be part of a warranty and now could be included in an insurance claim? I could easily be completely wrong it is just how I read it.

    That's exactly how I read it too.

    But that conflicts with this point:

    8. Damage resulting from alterations,
    maintenance including cleaning and
    restoring, repairs, faulty or defective design.

    Because it's such a well known problem that apple don't seem to be fixing, o2 aren't taking responsibility.

    Doesn't help that theirs two kinds of insurance - one for iphones and one for every other phone!
