Portman - can they do this?

    hi... quick question, do you have the passbook, if so and she reported it as missing, surely this is fraud and a matter for the police?

    It's a very good point, emmy. Why did the rest of us miss this? :o

    But would the police treat it seriously or view it as a minor "domestic" case where it's one ex-partner's word against the other?

    Would anyone want to involve the police when there could be implications for future access etc. ?

    And would it be bad citizenship to waste valuable police time on something something so closely linked to a relationship breakdown?

    Aren't we missing another point that there is material proof that the passbook wasn't lost? Fraud is fraud and is a criminal offense, however minor it may seem.

    "But I thought I had the passbook, not my ex-husband. After all, my son is living with me, so it makes sense for me to have had it ......"

    The passbook wasn't registered to her address - it was registered to my address!

    I have spoken to Portman customer services and they have confirmed they have breached their own terms and conditions. When a passbook is lost, they are required to send a form out, whereby both signatories have to sign it. My ex is a signatory not a trustee but effectively she has committed fraud although it will be down to the Portman to take action if they so please.

    I am going to address this with head office and ensure that all the money is put back into the account and then I will have to close it down in the correct procedure and put it into a new account with only myself as a signatory, so my son's nest egg will once again thrive!

    Is Portman going to ask your ex-wife to put the money back, using the threat of pursuing her for fraud if she doesn't?

    And what about the £200 windfall your son has just lost thanks to your ex-wife's actions?

    Good news - the Portman are reinstating my son's account and have closed my ex wife's new account. Only problem is my ex wife has taken £1000 from it, so we are not sure whether the Portman will reimburse this money or whether I have to get it from her? We will have to wait and see....
