    If the bank have admitted it and you take it to the FOS, in my experience, they will not deal with the data protection issue (even though they are supposed to) and focus on something else. They will not award you any more for D&I (£250) and you won't get anything else unless you can then show financial loss.
    You can look for yourself at http://www.ombudsman-decisions.org.uk on previous FOS cases.
    If you take it to the information commissioner, they will do nothing about it and look how the bank did not intentionally breach the DPA.

    You can still accept the money and take it to the FOS saying you've not had a proper explanation if you feel that way. Leave the bank account open if you want to make more money out of a repeat performance but open a different joint account if you don't want your ex to know your business.

    I work in complaints for one of the major UK providers and can certainly say this is not true. To be honest, the front line customer services for the most part probably wouldnt be aware you had raised a complaint unless you mentioned it.

    On topic, £250 sounds reasonable in this case, potentially push to £300 but i would take that and move on.

    Do you not think that the ICO will ask the bank to demonstrate what actions they're taking/have taken to stop such a breach occurring in the future?

    For one incident - Probably not. For a mass incident certainly.

    I've come across DPA breaches in the past and generally speaking if there was no ill-will or massive adverse effect it's a case of learn from it and move on.

    Not necessarily...depends how much work is involved, ie if it's passed to a 'casework team' or dealt with by frontline staff....

    BTW, it's £550 now.

    It doesn't seem to matter to them. I was underpaid on my private pension, I knew it was in the region of about £200, they argued and argued but they wouldn't back down. I Went to the ombudsman, they found in my favour, I got my 200 plus which they had to pay along with the (then) 500, bit ridiculous really when you think about it.

    Your complaint must have been one of the 1 in 6 that are escalated/assigned to a casework team or adjudicator, ie can't be dealt with by their frontline staff. I can see how a pension matter would need handling by someone a little higher up the FOS foodchain.

    That certainly confirms you wont get more that what you've been offered.
    For those on the forum who think I am wrong, lets wait and see what Dwain Pipe gets a in couple of years time after going to the FOS and half a year with the ICO?
