  • If you intent to put your complaint in writing I'd have a look at this:

    http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:32005L0029:EN:NOT

    Particularly:

    2. A commercial practice shall be unfair if:

    (b) it materially distorts or is likely to materially distort the economic behaviour with regard to the product of the average consumer whom it reaches or to whom it is addressed, or of the average member of the group when a commercial practice is directed to a particular group of consumers.

    1. A commercial practice shall be regarded as misleading if it contains false information and is therefore untruthful or in any way, including overall presentation, deceives or is likely to deceive the average consumer, even if the information is factually correct, in relation to one or more of the following elements, and in either case causes or is likely to cause him to take a transactional decision that he would not have taken otherwise

If the posters here can't agree then the offer would appear not to be particularly clear.

  • That's the EU directive, the UK consumer law basically says the same thing which can found here:

    http://www.legislation.gov.uk/uksi/2008/1277/contents/made

and the specific bit needed is detailed here:

    peachy
I understand the potential variance in interpretations, the description however added to the "kids den photos" on the site led me to believe I was paying for some enhancement of facilities. My two boys were excited by having a den to use in the evening on holiday.
I am still not sure what I received as an upgrade for the £168 paid. The PS 2 were available to any apartment that wanted to pay the deposit, we had not budgeted for the additional 100 euros that would have been tied up until we handed it back, so didn't have have it
    Thanks for your comments

You could afford a decent holiday and a £168 room upgrade but didn't have £85 to use as a deposit?

So to summarise if you have paid for a holiday and don't get what you expect continue to pay, it doesn't matter!

So to summarise, a refundable deposit. Did you really go on a foreign holiday and not have £85 for temporary use?
