    If you can't legally drive a car with high emissions, why are you allowed to drive it home following an MOT failure?

    My earlier post stated:
    You can quite legally drive a defective car. What you can't do is to drive an unroadworthy car.

    Which is correct.
    You can drive home following a failed MOT provided that your car isn't unroadworthy and if the emissions were the reason for the failure and if your current MOT was still valid, you could continue driving until that MOT expired (or until VOSA stopped you for a roadside check and gave you two weeks to sort it out).

    Anyway, this is going off on a bit of a tangent as it's not really related to the OP's query and is really just confusing matters.

    I must have missed where the op said they were on the way home from a failed test.
