Am I liable for contract my ex husband set up in my name?

My husband left in March this year; he had a contract with Virgin but wanted to take 'his' Virgin equipment with him -so that his children would not be without tv, he set up a 'replacement' contract in my name with a direct debit to come out of my bank account (which also had his name on it.) It was all done without me knowing how much a month it was going to cost me. I have never signed a contract in fact when they installed the new equipment on 30 March I had no idea how much a month it would cost me. They did send me a contract to sign dated 28 march which I did not receive until 11/4/13 - I have never signed it.

I have just had major health issues to deal with so this matter has not been my priority.

I cannot afford the £30 a month (promotional period amount) or the £41 it will cost from Sept 2013.

I would be quite happy to sign a contract for broadband only which would only cost me £23.65 a month but to get out of the phone and tv package before the end of this contract (which I had nothing to do with arranging) will cost me £121.

I was annoyed and told them to come and take their equipment out but was told that to cancel all three products from the contract I did not set up would cost me £180 and if I did not pay, they "would not want me to get a poor credit rating"!!

Yes, the contract that came with details of the cost, that arrived after the installation date (I do remember asking the installer how much it was going to cost me but he couldn't tell me), did have a section "your right to cancel before installation" - fat lot of use that was when it arrived nearly two weeks after installation!!!

So I'm stuck with this when I cannot afford it - HELP PLEASE!!!

As I said, I have had other things (health issues) on my mind for the last three months so this is not my priority. I have just come out of hospital and need to rest but this is having a very negative effect on my health now.

Do I really have a contract with them?
Could they really blacklist me if I do not pay?

I am really struggling financially and don't have the means, strength or stamina to take on the Virgin Media Giant.

    They cannot black list you as there is no such thing however if you failed to pay they COULD take you to court to obtain a CCJ which inevitably would have a negative impact on your credit reference file.

    Unfortunately a signed contract is not legally required, by allowing them to install the equipment and your use of it since receiving the T&Cs would most likely be sufficient to prove that you accepted the contract which would include any early termination fees. The point to argue/ query it was when they turned up to install.

    At this point you really just need to see what you can cut it down to. You say you could pay the £24 for broadband only and the current bill is £30 to go to £41. Are there any channels you can cut etc to get this down further? They appear to have packages with the three items at £18/month

    if you can find a way to manage the £30/month, then after 6 months you could downgrade to the starter collection.

    as you wont be removing any services, they are unlikly to charge you to do so.

    This will put the price down to £18/month + £14.99 for line rental. Still abit more than the broadband on its own but better than the £41

    I have been told today that after the end of the promotion (Sept 2013), I can downgrade the tv (to equivalent to Freeview) with telephone and broadband for £32.99 a month - I am curious about the £18 deal you mention, will check their website again.

    This just gets worse; I spoke to my estranged husband about this tonight and he was aghast that I was on such a high contract. At the point he spoke to Virgin to try and transfer the £30ish package he was on (the Virgin package was in his name at this address) he was told that he could not put it into my name - he was told that the best option was to set me up with a new contract like for like, that would be half price to me as a new customer. So, he was led to believe that I would be on the basic package (like he was) and that it would cost me half of what he was paying for the promotional 6 months i.e. around £15 a month for six months before going up to the £30ish that he was paying - We have both been misled.

    I do remember asking the installation engineer at the time he came to fit the new equipment, how much it was going to cost me a month - he said that he had no idea.

    I'm so angry about this!!!
