Problem with Sony & Xperia Z

Hi guys, hoping you can offer me some advice.
Nearly a month ago, my 3 month old Xperia Z developed hair line crack across the digitizer that rendered the phone totally inoperable. I was seriously disappointed and confused and pretty angry. The phone had not been misused e.g. had suffered no knocks, no drops etc and there are absolutely no other signs of physical damage anywhere on the phone - because it hasn't been!
Initially Sony point blank refused to accept that it could be anything else but my fault. After much explaining, they reluctantly provided me details for their sub-contracted repair firm (SBE) and arranged for a diagnostic test of the phone. This has come back today as "physical damage" and they are still adamant that this is my fault but are also quoting me a price of £238 which includes a new case(?) and a new battery(?). I immediately got back on to Sony and asked for the case to be escalated but I'm not holding out much hope of a different resolution.
There are a plethora of similar cases on different forums on the internet about the digitizer's breaking, but also the glass itself, possibly due to the extreme heat changes within the Xperia Z. I haven't seen one successful repair undertaken and I'm pretty sure that Sony are reluctant to do so as this would then set a precedent to fix any others and admit that there is in fact, or was, a manufacturing issue.
So, I'm now in a position where I've got to start looking at my other options - Sales of Goods Act? I'm aware that this means I would then have to go back and ask the retailer to rectify the issue but as my contract is with Three, does this mean I go directly with them or the shop I bought it from online which is BuyMobilePhones?
What choices do I offer them, replacement or repair?
Any help appreciated, as I've never to do this before but I'm just not prepared to just write off a 3 month old flagship Sony handset.

Phone is on a 24 month contract, so not "paid" for it as such.0
