The byelaw 5(xxxi) 1982 it is an offence for any person to willfully evade payment of any charges or tolls levied by the Commissioners for the use of the car parks or forest roads and the Commission is entitled to prosecute for breaches of the Forestry Commissions byelaws through the magistrates courts.
Does the ticket have the word 'penalty' in the heading, or 'Excess Charge' and who does it say you have to make payment or appeal to, what name & address?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It states on the top 'PARKING CHARGE NOTICE'
It says to pay the forestry commission, not to pay a warden or any ranger on site but either online at https://www.forestry.gov.uk/parking

The appeal option is on the website at the same address whic is marked 'Pay/Appeal'
Upon putting the details on the ticket in, that page comes up stating not found. I have the option to pay anyway but there are no details other than what I have put in. Seems like an honesty box type method to me.0 -
So if it doesn't have penalty in the title it may not be covered by byelaws. A 'Parking Charge' is just a fake one like Supermarket ones.
I would wait and see what letter arrives which is the usual advice, then you will know if they are saying the ticket is issued under the Protection of Freedoms Act or the byelaws. Do nothing until a letter arrives, IMHO.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Okay, I must add that although I know it is on the driver, the vehicle is not mine but in fact a work vehicle. So it's registered as a commercial vehicle.
It also has no signature of the issuing ranger, just his number '02'
I will upload a picture link now, see if that works to better identify the type of ticket.0 -

The registered keeper will get the Notice to Keeper. If that's a lease company, you run a risk that they'll (attempt to) charge you for the pleasure of passing the notice on, or worse, they may pay it and expect you to pay it, plus an admin fee, even though (if it's a private ticket), it won't be covered under their terms & conditions.haremscarem wrote: »Okay, I must add that although I know it is on the driver, the vehicle is not mine but in fact a work vehicle. Unless you know the person who the NtK will come to, and can intercept it, it may be best to appeal yourself. Especially as if they decide it's a Byelaw issue, then they may well pay up.
Who exactly does it say issued the ticket. Is it a PPC acting on behalf of the Forestry Commission, or is it done by the FC themselves? If the FC are issuing it as a private ticket, don't they need to be in the BPA AOS to get the keeper details?0 -
It's the company I work for, they know I use the van and are aware of the ticket. I suppose it was a pointless omission by me really.
The ticket is issued by 'forest rangers or officers appointed by teh forestry commission' according to the back of the ticket.

Hmmmm very interesting. I am trying to find out who issued the ticket from a friend, apparently I have heard on the grapevine that he knows the person who issued it.0
