Help with PPI against Burtons store card and Duet Card

Hi, I have made complaints against both of the above cards through Creation Financial, Santander and 3d finance i think it was. Both times they sent the paperwork from the original store filled application and each time the PPI section is filled in by a member of staff (ticks/ handwriting etc very different). They of course have come back saying that I do not have a case. So I complained to FOS, who after a month or so sent me the same letter for each saying their is nothing they can do because because it was sold to me before 14th Jan 2005. I am owed quite a nice amount from each and dont want them to get away with it. What is my next move please?

    Had similar issues with Santander re a store card taken out in 2001

    Get back on the phone to Santander. Ask who the underwriters were. Mine was financial insurance aka genworth

    Send them the FOS form, santander rejection letter and see what they say.

    Mine was successful in this manner

    If they have sent you the agreement, check it, it shd tell you who were the insurers

    Had a massive problem with Santander about this they told me they didnt have any records as it was from before 2000 so I took to FOS who told me to ask Santander for under writer so I did but they kept saying they didnt know and so on so FOS phoned and asked and they got the info straight away who passed it on to me, just goes to show keep going because I got told no records and no account of PPI and FOS got all info for me so I could make a claim with Genworth

    Here is Genworth mail address if needed I mailed them with account numbers and so on and got a refund for my store-cards within a month.

    You wil have to find out who your underwiters/insurers were.
    If you have had a response from Santander, now you complain to the FOS, who will ask Santander who the insurers were.
    Then you can complain to them.

    Duet card (Creation) settled with me directly after a threat of the ICO for failure to respond in full to an SAR and also failure to provide underwriters details after numerous requests. They settled directly with me after the FOS had said there was nothing they could do apart from maybe go after the unknown underwriter. It was settled as a good will gesture, for PPI and late fees combined, but was the exact amount it should have been had they upheld the claim. It wasn't a very large amount which probably helped. Exactly the same process played out with Ikano (another store card).
  • When I was a student I took out a store card with Creation Financial, what a mistake. The original credit limit was £1150 however as a student I used the card further, was in and out of employment and finally ran into financial difficulty. I contacted Creation and asked them to stop interest and the PPI insurance. In 2009 I checked my Credit file to find Creation had placed a default on my file and that the debt was now £4791 pounds. I have contacted them with regard to an SAR as this is an awful lot of money and I am loathed to pay it all back.

    Does anyone have any advice. The default will run out in 2015 and I understand the debt will no longer register on my credit file but can they still persue me for this.

    After 6 years of non contact the debt becomes statute barred.
    If you complain about PPI you acknowledge the debt and the clock ticks back to start the 6 years again if you don't intend paying.
    The banks have started contacting customers with PPI to start a future time bar. This will be 3 years from now. You still can't complain about PPI before the limit runs out on your debt.

  • Can someone clarify please. My father who passed away a few year's ago had a burtons store card paying ppi which he knew nothing about. My mum who is the beneficiary wants to claim from 1996 to 2005. I understand Santander were not regulated until 2005. Firstly can we still claim and who do we find out who the insurers/underwriters are/were. I know Santander will write back and say nothing to do with them but my father was paying 30 pounds per month for 9 years which is a lot of money. Burtons card was taken out in maidstone, Kent. Any help would be much appreciated.
