    I have to thank you all from the bottom of my heart for your help and trouble ... I will post Tribunal notice word for word tomorrow - or I may ask for the hearing to be set aside.

    The notice I dont have it in front of me at present basically said "No" to support group.

    As I only scored 6 points at the July 2012 ATOS assessment - the DWP DM kindly gave me nine further points (15 points) they put me in the WRAG on that basis ...

    The decision notice from the tribunal basically states not word for word "that I should remain on ESA and that the secretary of state (DWP) did not disagree with that as they had put me were I was (WRAG)... the Tribunal notice has no mention of a time limit for my ESA - they simply decided the appeal on the basis that it was an appeal against being put in the WRAG instead of the support group.

    does that mean the January (Fit for work) could now be brought into play by the DWP ????

    I argue not as I have an appeal against that position anyway and that will be held next few weeks ...

    Don't concern yourself over the ESA 1 year time limit. You are on ESA IR and that has no time limit.

    If you are correct, and we will wait for the word-for-word to confirm that, Then the WRAG award applies until Jan 2013 when you were found fit for work, so you remain on £112.55 a week until your next appeal hearing.

    Hi,

    I have just spoken to the DWP who have informed me that I was right .. They wrote telling me my claim was closed. The person who closed the claim re read the Tribunal decision letter and realised they had made a mistake and restored my benefit :mad: They did admit their mistake so what can I say ...

    This did not stop me getting the DWP letter and a P45 ... and pains in my chest with all the stress it caused when they suggest wrongly that I am no longer entitled to our little lifeline and support... I am grateful for the support and it makes you understand how important the taxes you pay in your career 30 years actually go ... (Most of the time anyway) ;)

    To all the kind people who have taken the time and trouble to reply - thank you - you may or may not realise how important the help and advice you offer at times when people are really down make a big difference I thank you for being so kind and considerate :beer:

    I have a better understanding of the ESA rules and thank god for places like this forum. :T:T:T:T
