Hi,

I need some advice please. I got a letter today stating that my ESA was being stopped. I have worked all my life until I became ill so not to au fai with this benefits system.

I was put on ESA WRAG after an assessment with ATOS, and the DWP awarded me points after ATOS gave me 6 points. I appealed for support group.

Meanwhile re examined by ATOS and found fit in January 2013. I again appealed. I didnt get invited to my Tribunal which was heard in my absence. I was awarded ESA WRAG but not support group.

I have now had a letter from the DWP which states my benefit (ESA) was stopped by the Tribunal decision on 1/7/13.

I cannot understand this and am desperate with worry these people are making me very ill. My meds have already had to be upped due to them

I cannot understand why would the decision I got stop my benefit.

Even if I had lost this first appeal I have a second unheard appeal ??

What is going on with these people. They destroy you and make you worse and less likely to get back to work...

Can anyone help us please ruined my weekend and making me really ill ...

Thank you

Ak

If you are asking for help can I suggest you edit your post to delete the insults? The people you are asking may be one of those you are calling names.

Do you have a partner that works?
When were you first placed in the WRAG?
Have you had any letters from the Tribunal? Have you confirmed they have the correct address?

What exactly does the letter state? When did you last hear from the tribunal? Did you elect for a written appeal rather than an oral hearing?

The other option here is that your benefit has been stopped due to the WRAG being time limited. What other household income do you have?
  • I think it might be because your 12 months of WRAG have now passed and if you have savings then you could find you're not eligible for anything despite your impeccable working record to date.

The letter dated 3/7/13 says I was entitled to WRAG, NOT support group. I wanted to go to the hearing but was not or did not receive notice of the hearing just got decision notice in the mail.

I have another appeal on the go which is due in about 6-8 week sth tribunal said on Friday when I phoned them

I cannot understand that my WRAG would be time limited and in any case I still have a second appeal against a Fit to work decision ...
    in January this year.

The letter sent by DWP did not state it was due to WRAG .. time limit. It just said as a result of changes (ie the tribunal ruling) my benefit would be stopped as of 4/7/2013 dated 9th July 2013. I recieved a benefit payment on 10th July as expected which seemed strange all things considered.

Conts based ESA is limited to one year for those in the WRAG, however you can apply for IB ESA once this has run out. Given your family circumstances, I would expect you would already be receiving this.

I'm still not entirely clear what has happened. What exactly does the letter terminating your ESA say?
