Civil Enforcement Ltd

Received a parking charge notice from CE Ltd. Was in Langborne Road car park in Whitby where the parking ticket machine requires your VRN. My wife (honest) was distracted by a phone call from hospital and added the VRN of our previous car. Do I pay ASAP to minimise the charge, appeal, or totally ignore the PCN as I get the impression from what I've read and watched on the box that the charge can't be enforced and CE Ltd will eventually go away. Any advice appreciated.

    I'm assuming the notice arrived in the post. So, what you do now is send a brief challenge such as this:

    Dear Sewer Rats,

    Re your speculative invoice no. XXXXXXXXX.

    The keeper rejects all liability for this charge on the grounds that it is punitive and hence an unenforceable contractual penalty.

    No further correspondence will be entered into. If you wish to waste time and money pursuing the matter then send a POPLA code per the BPA Code of Practice. You are warned that failure to comply with a code of conduct to which you have committed would constitute an offence under the Consumer Protection from Unfair Trading Regulations 2008.

    Get a (free) proof of posting. And come back for further assistance when they reply. Keep the Notice you have received, at the next stage we will want you to examine it for the various failures to comply with the law which it doubtless exhibits.

    Yes, and then take it to POPLA when they reject your appeal. Don't submit your POPLA appeal until you've properly researched here the correct appeals points that'll win, and then run it past this forum.

    Absolutely not. What you have read or seen is out of date in that respect. CEL have been issuing court papers to people who have ignored. Appeal, then appeal to POPLA, and you'll win.

    Just add that there is no loss and here is a photocopy of the ticket bought, say that a mistake was made with the registration number and the one provided covers the parking period.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Thanks for the advice guys. Was originally going to send a cheque with an appeal to avoid having to pay £90 instead of £45. not doing that now and not paying. Will follow your advice and write to CEL.

    Yep we know what we are doing and you won't be paying at any stage as long as you take advice over a strong POPLA appeal when you get the POPLA code.

    Indeed they are. But it is regulations rather than act.

    My address was possibly a little unfair to sewer rats. Our toothy little friends are simply doing what comes naturally - unlike the poisonous lowlife scum in the private parking "industry", who actually choose to be parasites and vermin.

  • Morning all. Sent an appeal to CEL on 19th July, got a reply this morning advising that the PCN has been cancelled though they now refer to it as a Parking Contravention Enforcement Notice. Result. Happy days. Thanks to all who replied for your help.
