Parking charge / CCJs

I went to see my Dad today and picked up quite a bit of old post that came there for me. I had two parking fine notices (High view Parking), and two letters from Debt Recovery Plus for said charges saying that they would "pass my file to the creditor's solicitor with recommendation to commence court action against you" if I did not pay full amount (or agree a payment plan) by 01/07/13.

This is first I've heard of the fines. Turns out my car is registered at my Dad's and I forgot to tell DVLA (which I will do now).

There was no court letters. Obviously I am now 13 days past their limit and am really worried that I will get a CCJ !!

I will call them on Monday and pay off most of the fines (261 owed, I can pay £200 Monday) and make an arrangement for the balance - but I am worried it may be too late?

When does the CCJ get put on your credit file?

    No! No! No! You are not going to pay them anything.

    And you can forget any CCJs too.

    These are NOT fines.

    This is a scam and they are trying to scare you.

    Spend a short while reading about other folks successful appeals against this rubbish and by the time 30 minutes is up someone will be along to tell you what to do to sort this out.

    It's just baseless threats from debt recovery plus and zenith collections, who are the same company. Don't pay them anything as you owe them nothing. Welcome to the world where companies try to fine you illegally. I'm guessing highview so its a tesco yes?

    Please read around and don't pay them anything at all, this is a scam! There is no other way to describe it, the only people who pay are the mugs, and the ones who think this is a fine!
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I've not paid! :o) I was going to ring them tomorrow and pay but I checked on here.

    Advise seems to be just ignore.

    However, should I not call just to let them know my actual address? If I am one of the 0.01% that they issue court papers too, I don't want these going to the wrong address.

    I really cannot have a CCJ on my credit file, as I am looking to remortgage in a few years.

    It's not going to court with highview, I've never ever seen them issue a claim. And if you were issued a claim you'd never get a ccj even if you lose there, you simply pay within 28 days and the claim is not registered. Can I just say though that if they were stupid enough to issue you'd get help with a solid defence from here and over on pepipoo.com as well.

    Goodness me - you are so sceptical.

    The parking scammers love people with your reluctance to accept that what they are doing is a con-trick.

    It's only because some folks pay in fear that these parasites continue in their vile business.

    You have committed no crime/offence.
    You are not going to court.
    You are not going to get any CCJ.
    And .... you are not going to pay anything at all.

    Do NOT contact them at this point.

    Please follow the sound advice you have received from Stroma and Coupon-mad.

    You also need to register your car at the correct address. You could invalidate your insurance if you don't and pick up a real police ticket.

    You certainly need to keep in the loop as far as further communication goes. It's the real papers from Northampton court that you need to watch out for.

    You can either visit your Dad's regularly, or get him to get the mail to you quickly, or, as you say, let them know where you now live.

    If you do the last choice, you do NOT admit to being the driver, only the registered keeper and as suggested, you deny owing them anything in that letter.

    Not sure if Highview are doin court at the moment - others may advise.

    Thanks for all your responses. I've registered the car today at my correct address.

    The thing is my Dad is moving soon, and part of me envisages a court letter at that address that I won't ever get, a court hearing I won't know about, an automatic defeat in the court as I didn't attend, and a CCJ on my file that I can't remove.

    I know I am probably being reactionary and panicking...part of doesn't want to acknowledge these companies, but part of me also thinks that it's best they know where I live, just in case.

    Tell you what you'd be the first that highview takes to court, despite giving thousands of these fake tickets each year. You appear not to believe that this won't go to court, you are being sucked into the trap they've set you, we have no financial vested interest in you paying, they do! Don't you understand that these people lie and break the law to get money?

    As for your father moving, well setup mail redirect with the Royal Mail , something that should be done in any case for prevention of identity fraud.

    If you were to receive a default judgement because the papers were sent to an old address it's relatively easy to get it set aside, but it's definitely something you want to avoid if you can help it.

    Highview don't take people to court but if you're worried about it let them know your current address as Guys Dad suggests. Do it in writing (keep a copy) and do not name the driver. The worst that will happen is they send you more threatening letters which you can continue to ignore.
