Waiter spilled water on my wifes phone

    Why didn't you raise it at the time with the manager? After the event is hopeless if the waiter denies it, it's your word against his.
    It's like complaining about a bad meal or hotel room after you have left the establishment-you've severely compromised your case.
    No free lunch, and no free laptop ;)

    It's also common knowledge that cars get hit by other cars all the time so does this mean that if your car was damaged by another driver and you were not at fault, you wouldn't attempt to claim from their insurers?

    Common knowledge or not, the owners and workers of the bar or restaurant must still ensure that their duties are carried out without harm or loss to their customers and if they don't do this, they should cover the cost of any losses caused by them.

    If your wife had spoken to the waiter immediately that this accident happened, you'd know whether the bar was going to do anything about the accident and either be happy that the phone was going to be replaced/repaired at the bar's expense or be asking what you can do about their non-acceptance of liability.

    Did the waiter even realise that water/wine had been spilled?
    Did he say anything to your wife at the time? e.g. "Sorry about that".
    Did your wife even notice that liquid had been spilled at the time?

    So just what did your wife do when this happened?

    Did she speak to the staff at that point?

    Did she turn it off, dry it off and then put it somewhere to dry....
    Or did she just wipe the water off and carry on as normal....

    If it worked fine for a day and then stopped, then the action after it happened by your wife is the most important part.

    But why leave your phone on the table.... There is a very well known scam of someone coming up and talking to people while palming their phone into their pocket.

    Its a bit silly to have a phone on a dinner table anyway, food and drink is a risk and then to use the phone would be very rude. However surely no one who had water damaged a phone or any electrical item would immediately turn it off and put it somewhere to dry out for a substantial amount of time, they wouldn't simply carry on using it as that will cause damage internally.
