PPC Ticket

Options
Got a ticket from a PPC the other day. I've had one from these a couple of years ago, ignored it and nothing happened. But it seems that they are starting to get smarter and chasing harder with court claims as well these days?

Should I wait for them to write to me, or start the appeals ball rolling now? I think it's only one or two of the big parking companies that are starting court claims at present? But I'm sure the others will follow, if it proves to work for PE.

Details of my 'offence': parked on beach (tidal) that is supposedly permit holders only, and I don't have a permit. Tide was out, so loads and loads of space, I wasn't inconveniencing anyone

The PPC in question is a very small one - they're not even mentioned in the PPC letter chains list. I'd rather not give out more information yet, as it seems that some of the PPCs monitor these threads.

What sort of grounds for appeal might I be able to use?

You need to tell us who gave you this invoice, the advice is dependent on that is, and if its in England or Wales

Same firm as on this thread full of advice:

    https://forums.moneysavingexpert.com/discussion/4694577

You wait for them to write to you and then send a soft appeal to get a POPLA code (I linked a pepipoo forum thread of example soft appeals, in post #13). Then you squash 'em with our help, at POPLA stage.

You might also want to look into who owns the foreshore. It is unlikely to be in private ownership. It could be that this PPC infests the beach on the behest of some landowner but is going beyond its remit on the foreshore (the wet bit), which may well be owned by the Crown Estates or the Duchy of Cornwall or some such.

    Their website is a joke

    http://www.as-parking.moonfruit.com

Moonfruit.com offer free web hosting, this joke of a company can't even afford to pay about £50 a year for their own domain and hosting.

And they are breaking BPA's guidelines over grace periods:-

    Q. "I was getting change to buy a ticket, will you cancel the charge?"

    A. There is no period of free parking, motorists are required to have sufficient change with them BEFORE arrival. Appeals submitted on this basis are invalid appeals

So another AOS member who is deciding what a motorist can appeal with, an absolute joke! Anything sent is considered an appeal, wonder if parking prankster will enjoy appealing to these idiots? lol
Please note, the following are NOT valid grounds for appeal and are beyond the scope of the formal appeals process:

Explanations as to WHY the contravention occurred.
Requests for mitigating circumstances to be taken into account.
You disagree with the terms & conditions of use.

Correspondence of this nature will not be accepted as a formal appeal, however MAY be given our consideration in exceptional circumstances.

For a limited period we are offering 'Pay & Display' machines to the right car park/s FREE OF CHARGE!.

Please contact us to arrange a site visit.

Our revenue comes from the enforcement action we take on motorists who either fail to pay for their parking or park in breach of the site specific terms & conditions of use.
