colino, i'm not trying to wind people like you up but i must say you sound pretty wound up... i guess i'd not mentioned the _other_ things this garage tried to pull, minor 'permissible' stints which, after a while start to grate on you as the consumer.

you may think otherwise but i think my asking this question is wholly appropriate.

That's what businesses do I'm afraid. In fact it seems to be the case that the bigger the company the closer to the limit they will push things. The only way to avoid this is to only deal with smaller independent businesses. But even that doesn't always work, because some of those owners learned their trade from working for the bigger companies.

The brake pads aren't at a level that would warrant an MOT fail now, let alone 4 months ago when you got the vehicle.

Brake discs are made from bare metal and brake pads when a vehicle is used often will clean minor surface rust off the brake disks. If it's left mostly unused as you have claimed, then the minor rust become problem rust and cause pitting on the brake disks.

I'm afraid you have no grounds to go back to the original garage to complain on this.

so after owning the car for 10 months you want the dealer to replace brake pads that still aren't an mot failure? and four months out a warranty which likely wouldn't have covered wear and tear items like brake pads anyway?

    good luck...

This is a total non-issue. The second hand car passed it's mot and would still pass another 4 months later by the sounds of it. Some people are never happy.

. . . both rear brake pads are worn to only 2mm (legal limit is 1.5mm) and brake discs significantly corroded.

Just to add to the answers already given, the rear brakes don't do anything like the work that the front brakes have to do. That 2mm could take quite a while to wear down to 1.5mm. No idea how bad significantly corroded is, could be something which is easily rectified with a bit of emery cloth but we can't see them from here.

Brake discs will rust simply by being left overnight in the rain. Leave it for a week and they'll become "significantly corroded" until you have chance to use the brakes a few times.

Your pads you openly admit are still legal even now.

Not seeing how this car should have failed it's MOT 4 months earlier.

Before spending any money, just re-do the brake bed-in process, e.g. accelerate to 70 and break firmly (but not excessively hard) down to 20, repeat a few times, should leave you with nice shiny flat discs.

    hi all

my other half has an approved used mini cooper which came with a free mot (and free mot repairs) at 6 mths as part of the purchase. well we went back to the dealer and got it serviced and mot'd, and it passed with flying colours (without any advisory notes etc).

you are surely fishing aren't you?

you have had a MOT that passed with no advisory's in the testers opinion but now you want the place to pay for them even though they don't need changing months later.

i wish i could buy a car and do that but in the real world it dosen't happen :rotfl:

they have found, incidentally, that both rear brake pads are worn to only 2mm (legal limit is 1.5mm)
There is a minimum thickness for brake pads but I don't think there is a legal limit.

Yes, but what rights does the OP have?

And who can they claim against?

the car is now in another garage 4 months later, (but hardly used as we have a new car - i.e. <300miles on the clock since the mot) and they have found, incidentally, that both rear brake pads are worn to only 2mm (legal limit is 1.5mm) and brake discs significantly corroded.

    Kwik Fit or similar?

What is the car in the other garage for?
