Cancelled Parking Ticket Now Being Pursued by Bailiffs

Hello - I'm after a bit of advice for a neighbour.

A while ago she parked in a multi-storey car park, paid for her ticket and returned within the time on the ticket. As she got back to her car, a traffic warden was in the process of issuing a penalty charge notice on her car. The ticket had slipped sideways down the dashboard and the warden hadn't seen it.

She showed him the ticket and he agreed to cancel the PCN. He gave her the print-out from his PCN gadget, but drew a line across it.

Bailiffs turned up on her doorstep yesterday demanding a substantial amount for non-payment of the PCN, plus attached fine and charges. She cannot afford to pay this as she is on a very low income, is a single mum to a 10-yr-old, and we are in HA housing.

My neighbour has all the documents, beginning with the ticket, on which the traffic warden had ticked the time stamps as he was checking it and the PCN which the traffic warden had struck through. She has endeavoured to explain the situation, with the proof, to the council and thought that it had been resolved. All her attempts to speak to the Bailiff were met with "I'm not interested in talking to you."

She was in quite a wretched state last night, but says that she is going to contest the case, as she did nothing wrong.

Does anyone have any advice or guidance as to how to go about this? Any suggestions would be much appreciated.

    It makes me wonder if she returned within the time, why was the traffic warden in the process of writing the ticket out.??

    not on view would be my guess (slipped on dash)
    Crafty s-od has not cancelled it but just told your neighbour this.
    Go back to council to sort it out, a mistake has been made somewhere.

    This, possibly?:
    The ticket had slipped sideways down the dashboard and the warden hadn't seen it.

    Did she not receive a Notice to Owner, Charge Certificate or Order for Recovery?

    Yes, she did, and each time spoke to someone at the council to explain the situation and believed that that was the end of the issue. She has copies of these letters.

    So she relied on verbal assurances from the council. Never a good idea.

    The council has followed the correct procedures and unless she has some written confirmation from the council that the PCN was cancelled, there is nothing she can do.

    I would still take the time to repost this on pepipoo.com just in case anyone else can come up with other ideas.

    Oh why oh why would she not have just written a one-liner 'appeal' response as it tells her to on these Notices? You cannot deal with such things over the phone!

    Do try pepipoo and do try an emailed (paper trail!) complaint to the Council IMMEDIATELY to the top. She should not be paying a bailiff IMHO and should be helped to explore all avenues.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
