Advice please - Ted Baker

Options
Could someone please give me some advise please?
I bought an expensive dress for my daughters graduation & a wedding the following week. During the meal some of the beads started to fall off & by the end of the evening it was very noticeable. They only came off round the neckline & the beads under the bust and the back were fine.
I was unaware they had fallen off & took the dress to be cleaned the next day.
I contacted Ted Baker to ask for a refund & had to email them photos as proof.
I have now had a reply asking details of the dress & they will try & source replacement beads for me to have repaired myself.
I have told them I wish a refund as the dress was not up to standard (stating sale of goods act) & she had to get another dress to wear to the wedding.
Do you think I have a case for a refund?
Thanks for any help.

if the damage is minor and can be repaired easily, within reasonable time, at no additional cost to you and without causing any significant inconvenience, then the shop can insist on this as a first option, although this will not stop you from taking it back if the repair is unsatisfactory or there is something else wrong with it.

I mightve missed it but when did you actually notice the beads were off?

When did you buy the dress?
Did you buy directly from Ted Baker or from another retailer?
    How much was the dress?
How did you pay? (Cash, credit card, debit card or gift voucher)

So you bought the dress for your daughter? (just clarifying as your post originally gave me the impression you bought yourself a dress for your daughters graduation and a wedding) And it was very noticeable but you were unaware they had fallen off? I take it that it wasnt noticeable then if you didnt notice before taking it to the cleaners?

I think perhaps its too early in the morning for me :D

I bought the dress for my daughter to wear at HER graduation ball. The dress was perfect when she left the house, during her meal a few beads fell off and by the end of the evening a lot more had came off (only in one specific area).
Next day she went to work & I took the dress (still wrapped in the cover} to be cleaned. I didn't look for any damage & handed it over. It was only when she returned from work that evening that she told me what had happened. If I had known the beads had came off I wouldn't have taken it to the cleaners.

Given that 4 weeks passed since you bought the dress then 'acceptance' has almost certainly occurred. If it has then you no longer have the right to reject for a full refund under the Sale of Goods Act. Instead the retailer gets to pick between a repair, replacement or a refund.

Technically if you havent accepted the goods, you can reject for a refund. Acceptance occurs in several ways. By implying you accept them, by doing something that is inconsistent with you not being the owner and if a reasonable length of time passes without you saying you reject them.

I'm not entirely sure if you sewing her into the dress would be seen as acceptance or not under the circumstances.

Once acceptance has occurred, you can request one remedy (repair, replacement, refund - which can be partial to take into account use you had of the goods) over another but the retailer can refuse if disproportionately costly.
