Hello, Is anyone claiming for flight delay on Monarch flight ZB239, on tuesday 28th September 2010, I have had a claim in for this flight since November 2012, and Monarch do not accept that the flight was 7hours 50 minutes late, they say it was only 162minutes late which is rubbish. Is this just them trying to see if I will go away, I sent them a flight stat print out which clearly shows the delay. I would be pleased to know if anyone else is claiming. Thanks Bill.

What time was your flight?
I think there were two flights that day, both ZB239.
One was scheduled to depart at 14:00 and the other 19:10.0 -
Hello, I think there was only one flight that day, 1400 hrs was the scheduled time of dep, 19 10 hrs was the original time but Monarch changed it. Cheers Bill.0

Ah right, that makes sense then.
19:10 - 14:00 = 5h 10m.
Monarch say delay of 162m = 2h 42m
5h 50m + 2h 42m = 7h 52m
Monarch are calculating it from the amended time, you're going off the original time.
Really this is a claim for cancellation and re-routing under Article 5 of the Regs and not a delay as such (although you can see how closely connected they are, hence the Sturgeon and Nelson Judgments).
When were you told of the change? If it was before the 14th Sept 2010 then you can't claim. Any later than this and you're ok.0 -
hello CobyBenson, thanks for your quick responce, I don't understand your answer, I was notified that the revised time of departure would be 14.00 hrs, and the time of arrival at LGW would be17.35hrs, The actual time of departure from arriceffe was just after 21.00hrs and time of arrival at LGW was 1.25am the following day. 7hrs 50 mins late, that seems to me as a delay. Hello, can't remember when exactly but before 14th sept, surely if the airline state the departure time of 14.00hrs then when you get to the airport you see the flight is delayed which turns out to be 7hrs 50mins delay then surely that counts as a delay, otherwise what is the point of stating a departure time? Or does this mean that airlines can change their times willy nilly and if the flight is late it doesn't matter? Thanks again for your interest, Bill.0

You're absolutely correct, as you were told before the 14th Sept this is a straightforward delay claim.
Don't listen to Monarch, they're talking rubbish.0 -
