    No they are not, the NTK was the first letter but the liability letter is the second one.

    I realised after I'd posted that it was the second letter, and after thinking about the dates it was the 13th and I recieved the first letter on the 20th/21st I think.

    Should my next move be to immediately send the letter Stroma has quoted above requesting a POPLA verification code?

    Or is Guy's Dad correct in that it's too late for POPLA and my options are to pay or wait to hear from the courts?

    You can do what stroma says. They might play ball, but don't bet your shirt on it. Worth a try.

    My thoughts are that you won't get a popla code even if you send what I wrote above. What it shows though that should it go to court that you tried to be reasonable before court action is initiated. This will make your case stronger as it shows that you tried to stop legal action, and parking eye are not being reasonable.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    So you don't think they'll drop it if I start bringing up POPLA as it's so late in the day?
    I'm 21 and the thought of going court is horrendous, I don't know what that means, is it really likely?

    Sorry but I am amazed that you didn't get any clues about how to respond from all the other threads about how to respond to a PE Letter before Action? You are too late for POPLA but not too late to respond. Read up on other threads please, that's why I went to the trouble of linking them. Clearly you are allowed a 'Grace Period' under the BPA Code of Practice (which you should read in order to get ammo for your response) as you only 'overstayed' 13 minutes going by moving traffic pics at the entrance and exit, that doesn't mean you 'overparked' at all.

    I would just add, was it Aldi???

Come back for more advice if you need help to word your response, and do answer Stroma's questions as it helps us to see the individual case details beneath the 'same old' thread and to advise accordingly, if you need more help after reading other replies already given every day. :)

    Look the small claims is held very informally, just a judge, you and them. You say down basically having a chat and running through paperwork, you give your opinion they give theirs, the judge decides who is right or wrong.

    But it's not even likely to go there as if you put in a real good defence they probably will drop it, they are trying for intimidation of victims, take a look at your last post, you sound very intimidated and probably will cave and cough up.

    But we and the guys over on pepipoo.com can help you with this, you will get a full defence, and through that you will know what to say should you go for a chat with a judge in the small claims, they by the way don't wear wigs and you have to stand in the witness box.

    Should there be a "don't" in there
    ie and you don't have to stand in the witness box

    Small claims court is so informal that even if you were to lose you won't have stand in the naughty corner.
