Private eye, registered letter

Hi I've been reading though but not found anyone saying that the letter they have received was a registered letter. Over stayed by a whole 30 odd mins back in November at 3am in the morning. Honestly didn't see any signs about only being able to park for 2 hours. All I wanted was to sleep for a bit as I had been travelling for a long time.
Read lots of advice back in December about ignoring everything you got from them which I did. Got 3 letters in total last one being sometime in January.

This morning I received a registered letter from them, a Letter before action. And also have seen a few people now saying they are taking people to court. Is this likely to be the case with be me since it was a registered letter that they sent to me.

Really didn't think I would hear from them again as it's been so long. And what's more annoying is I didn't just drive in park and leave, I filled my car up with petrol which was £60 and bought food and drinks as well. Guess which service station I will never stop at again and give a penny of my money to!!

    Name
    Address

    Date


    Dear Parking Eye


    Thank you for the letter ref xxxxx to the Keeper dated xxxxx. The keeper rejects all liability to your company. Attached are copies of receipts for that date clearly showing there was no loss incurred.

    If you proceed with any spurious claims it will be fully defended! There is nothing further to add, you have the keeper's final response to this matter.

    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    That's because there is no such thing as registered post any more so your search would find nothing!

    Recorded Delivery. Yes there was a post about it yesterday from someone who had got the same. The advice is to respond to a Letter before Action but not saying who was driving - because it may work(!) and if it does go to court it looks more reasonable. Also bear in mind if they do pursue a small claim you can get help with a defence on pepipoo forum and IMHO should not just pay it. In fact the amount they can claim in small claims under POFA 2012 would in some cases be less than the escalating amount they are trying to make you pay in recent letters!

    Under POFA 2012 they can only claim the amount of the Notice to Keeper plus court fee and maybe £50 small expenses (not solicitors costs or anything). And that is only IF they win of course, which with a good defence and a canny judge they wouldn't.

    Before you send the short reply suggested by Stroma (adding perhaps that 'the driver' also used the petrol station and shop and so cannot have been parked for the time claimed at all) can you just tell us whether the initial Notice to Keeper was received by you within 14 days of the incident? If not I would be sending something much stronger to try to force them to drop the case, like in this response from Broadsword on pepipoo:

    And if you do that, also send the DVLA complaint email template too (tweaked to suit your case). If PE are trying to pursue an unlawful and late Notice to Keeper then get angry and get even by reporting them to the powers that be!

    I am pretty sure that I did receive the letter from them within the 14 days. Because it has been so long and I've not heard anything from them I no longer have anything. I assumed they had given up. Oops!

    I will do as you have suggested and hope that I can get the matter dropped.

    Yep, send it anyway because at that time they were often seen to miss the 14 day deadline. Complain anyway!
