Brilliant! Thanks yet again Ukomaas. I am once again amazed at how helpful everyone is on here!
I wouldn't have had a clue that the end of my appeal had been cut ff & therefore disregarded. I will send a written version ASAP.0 -
Hi,
Just to let you know, my appeal was successful & the charge has been cancelled.
I received confirmation yesterday and I will post it on here as soon as I get the opportunity. Basically, even though I raised multiple points, they only concentrated on one area which was the failure of PCM to prove they had a genuine loss by me parking there.
I really want to say a massive thanks to everyone who helped me with the appeal. I was worried sick when I received the charge & you all put my mind at rest straight away. The service you are offering is selfless, generous & downright brilliant.0 -
Great news FL - another one bites the dust on the pre-estimate of losses.
Not ParkingEye this time, so you're not alone Rachel in fouling up on this. But don't worry, Steve Clark will be along soon with a training course for youPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

He's the BPA guy who has been arguing (with Trisontana) that costs can be included in, losses - despite every PPC being trounced on this at POPLA. If you read a few posts before your update in the POPLA Decisions sticky you'll get the drift.
Rachel is the PE in-house solicitor who seems to have been responsible for their recent wave of court proceedings against motorists.
I've just also posted a link to my comments above in there too. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

That is great news - and we would love to see the whole decision (including the assessor's name) so we can race to add it to the POPLA decisions sticky thread - it's at the top of the parking forum board if you want to add your successful decision there yourself, with a link to this thread!PRIVATE 'PCN'?
