    Yes that's a nice reply and well worth trying, they will probably reject it though as being generic lol
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    From what I understand from my research so far is that the operator of the service station is also the landlord.

    It has been suggested that I contact them and ask them for following.
    • A copy of the contract that I enter with them (the landowner) on entering their land.
    • Do they themselves intend to persue me for loss of business/expences for my overstay?
    • A copy of their contract with Parking Eye which would state that they contract PE to act on heir behalf in this matter.
    I have been told that the landlord is unlikely to persue directly as this would be poor PR for them (major player ect) and if they won't persue it blows PE out of the water as well because they act on the landlord's behalf.
    Is this correct?

    On recieving the origional letter I also spoke to a lady called who deals with PR and parking at this MSA and offered to pay the day rate (£10) as I had obviously stayed over.
    She refused to accept payment and said it was up to PE now.

    When I asked how the charge could possibly increase from £10 to £100 for around a 40 min overstay and how this reflectcted their costs/losses she could not answer.

    I have made two offers to pay the day rate but these have been refused.

    Does this go any way as mitigation?

    Coupon Mad, what is TSRGD and how may it help my case, I kinda understand what you are getting at with regard non compliance to cameras/signs but what are the specifics please.

    Google the TSRGD 2002 and you will see it's the traffic signs 'bible' used by Councils. Traffic signs have to comply with it in minute detail. And the quote I gave you says that even signs INSIDE the MSA have to comply. PE signs are nothing like Council signs! Quote directly from the Dept of Transport link I gave you linked when you click on the word 'this' in post #7.

    I would not be 'asking' the MSA for anything. TELL THEM in a complaint what you think is wrong and remind them that you already made a reasonable offer of £10 which was refused - infact why not enclose a cheque for £10 payable to Parking Eye with their (PE's) copy of the complaint. A very reasonable offer now forcing PE's hand one way or another.

    You do not need to ask either party for anything except to cancel the fake PCN otherwise you will make official complaints to the Dept for Transport and the Highways Agency for starters, as well as the BPA and DVLA for PE's non-compliance with their own Code of Practice (you don't have to explain what).

    You are not asking for mitigation you are complaining and making your case so 'hot' that PE will drop yours in favour of an easier one and bank the £10.

    Apologies for butting in here but am I right in thinking that the general consensus now is that an LBA from PE WILL result in court papers?

    I have one over an alleged incident in Dec, received LBA about a month ago, nothing since.

    Not necessarily - but I do now suggest responding to an LBA and so do most on pepipoo forum. PE are issuing hundreds of claims in a scattergun approach so posters here need to try to make theirs one which PE do not want to take further.

  • Hi everyone, same boat as original poster.
    I over stayed in a motorway parking facility by 40 mins approx, got the first letter etc and they keep coming!! Now I've just had the one that I had to sign for and they say if I don't pay the 100 pounds ill be taken to court.
    I originally didn't pay after reading old posts..... Looks like they people must be paying these fines because they are still in business, anyways I'm not paying them a penny and they can take me to court!! I would rather do jail time than pay... Especially as motorway signs and adverts say "if your tired take a break" do that and you get a fine!! Sums this country up.
    Ill update what happens for future people getting these fines

    Same as above but you all need to start your own threads for help and you SHOULD RESPOND to a Letter before Action and in a strong way IMHO. There are hundreds of people defending Parking Eye small claims right now so if you get court papers you must respond to them and defend (get help on pepipoo forums).

    This is Muffin the Mule's thread not a general discussion - and on a parking forum we can't have a mixed load of cases on one thread as it leads to confusion and mistakes over dates & details.
