    Lol yes that is quite right. I think it would only make matters worse. Access to my DD is quite difficult and there is no court order in place yet.

    The other thing, if she is having a percentage paid through housing benefit she might be paying less out than you would have to give in CSA.. You might have to give her an extra £50 yet she only has to pay out an extra £20 ... for example.

    Or she might just want to mess you about.. who knows what goes on in the mind of a woman?!

    I can't see why it would make any difference to the total you are paying though..

    Thanks for your reply. The CSA is quite clear I pay less because I pay 100% mortgage. Should this change I will pay more CSA. Don't get me wrong I would financially benefit from paying more CSA and half mortgage. But effectively she will not paying half mortgage and receiving 25% more CSA money. That's what I don't understand

    Acess will be difficult until a court order anyway, may aswell see her all the time by living there.

    yes you are liable for the ortgage which you'll be paying until your dd is 18/21 then be forced to sell. i wouldn't bother paying it, let them repo

    Is her boyfriend working and has he officially moved in? Where did he live before? Judge are almost always sympathetic with the parent with care staying in the marital home when children are involved, however, this is is less the case when the parent with care is with a new partner who is expected to support them (if they can't support themselves).

    Have you looked into considering pushing for the sale of the house?

    In relation to maintenance, are you actually paying the sca directly, or paying her directly what is half of csa. If you are officially going through the csa, I am very surprised they would allow you to pay half because you pay the mortgage. They usually don't get involved with what other arrangements you have and only expect you to pay on a fixed formula. I would definitely look into this because they could come back and say you have arrears (and not care less about your mortgage situation), or if you are paying her directly, she could at anytime go to the csa anyway.

    My suggestion depending on her and boyfriend relationship and circumstances would be to pay the full csa due, half of the mortgage and push towards a sale (or them buying you out if they can afford it).
