parking fine

I received a parking ticket 6 weeks ago for not displaying a disabled badge in a disabled bay, on a free car park run by UKPC, at a local retail park,I had knocked my badge as I got out of the car and hadnt noticed,the card had fallen onto the seat of the car and was open,but was not displayed on the dash. I saw the attendant as I came out of Asda and spoke to him but he insisted on giving the ticket and said it could not be cancelled.I have since had letters asking for £50,£90 fom UKPC, and now for £150 from a debt recovery company.What should I do now.

    However, in your case, have you received any further communication from the Parking company?

    If so, what was it headed and what date? Also, date of contravention, where (Shop car park, public car park?) and which Parking company (PPC)?

    Lastly for now, are you in England or Scotland as different legislation applies.
  • I am in Manchester and the ticket was issued by UK Parking Control ltd on 30/04/2013, they have sent me 2 letters asking for payment the initial amount was for £50 and if not paid, it then went to £90.This was for not displaying a disabled badge in a disabled bay.This was at a retail park outside Asda the car park is free there are no payment machines.Today I received a letter from a debt collection company called Debt Recovery Plus Ltd,stating that UKPC have referred the matter to them and charges are now £150 and if this is not paid by 16/07 then they will recommend their client take court action.

    They can recommend all they like , this highly unlikely to go anywhere near a court, this if it did go there would be a first for UKPC. Also expect Zenith Collections to contact you next, they are in fact Debt Recovery Plus pretending to be someone else.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    As this is a Retail Park, Google the name of the Park to find a newspaper or retail article saying which managing agent runs it. Send them a complaint and a copy to UKPC because they cannot insist on a Blue Badge and they (UKPC) already knew you are disabled as you showed the attendant your Badge, see this explanation:

    Enclose a copy of your Blue Badge and say as far as you are aware it was displayed as you left the car (not that a Blue Badge applies on private land), you have no idea how it become dislodged onto the seat but that it was still visible and to pursue this matter with intimidating letters is illegal harassment under the Equality Act 2010.

    Tell both parties that UKPC are already aware of your disability because you spoke to the attendant as you came out of Asda but he insisted on giving the ticket and said it could not be cancelled; so he was personally liable for this disability discrimination as he 'knew or should have known' that you were disabled and lawfully allowed to park there.

    You should point out that to pursue the matter now they (Retail Park and UKPC) know the passenger was disabled would be a breach of the Equality Act 2010 and both parties would be liable for damages.

    Do some digging to find out who runs the Retail Park as you will have a lot more clout if you target them assertively.

    Oh, and add that you WILL NOT be responsible for UKPC's £15 'admin fee' that they have been known to try to charge disabled people under these circumstances and you have no interest in membership of DMUK! See here where I wrote a complaint for someone, you could tweak this one (remove the POPLA stuff as you are out of time for that, sadly) but use the bulk of it, in particular the quotes from their old Blue Badge Policy which they have changed to unfair rubbish - and mention that you about TS taking them to Court...see post #4:

    If you use that last version, for now just send it to UKPC in the hope of forcing them to cancel it to stop you telling their client in the car park about their practices.
