Issue with Vodafone

Just after a little advice if possible

My contract was due to run out March 2013.

In November 2013 I received a telephone call from Vodafone trying to offer me something better than I was on, I advised that I was waiting for my contract to run out then I was going to go PAYG. The guy offered me such a deal I couldn't really refuse as it was going to be cheaper than a top up every month.

I advised him I didn't want a 24 month contract so he signed me up on a 18 month contract, he also applied a discount to make it cheaper for me as he discussed.

I logged on to check my bills and happened to notice that I was on a 24 month contract not a 18 month contract, when I dug a little deeper I also found out that although the guy said it was start from immediate effect it didn't actually start until March 2013.

I contaced Vodafone and they said all their notes state 24 months was agreed, I advised them that it wasn't and I didn't receive any contract via email as they stated. I tried to get them to admit that I had been mi-sold my contract and I wanted them to cancel my contract ebecause of this but all they offered was a 3 month waiver of line rental.

I emailed Guy Laurence (CEO) with my complaint and today received a call from the Exec office regarding the matter.

The guy I spoke to did admit that there was an 18 month discound applied and didn't know why it would only be 18 months if it was a 24 month contract therefore seeing that maybe just maybe I was correct and the sales agent had mis-sold me my contract.

I advised again that I wanted him to terminate the contract but he said he would just put it as an 18 month contract, I tried to advise that I wasn't happy that the agent said it would start in Nov 2012 when in fact it started in March 2013 adding another 4 months onto the length of the contract but he wouldn't have any of it.

I apreciate some people will think I should be happy with being put on a 18 month contract but I am not happy, I don't want to have to stay with Vodafone, giving them my hard earned money for another 14 months, I'd rather go PAYG.

Can anyone advise me if I can go any further with this or if I do indeed have to stay with them for another 14 months?

    I didn't know this... I thought if they chose to give you a new deal then they end one contract and begin a new one.

    And I think it was 12 month contracts that they did away with when all these new smart phones came into play

    Its normal amongst all the networks to add any remaining time left on a previous contract onto a new contract.

    It was 18 month contracts Vodafone stopped. Its 12 or 24 now.

    i think you misunderstood what they ment.

    your new contract did start immediately, it would have changed and started in november.

    but any remaining from your old contract would be added onto the length of the new one.

    if you change a tarrif via an early upgrade, your new tarrif charges will start straight away.

    Did you get a new phone with the upgrade, and if so, did this come in november?

    My last early upgrade with T-Mobile they phoned me up with 4 months remaining on my contract and offered me a deal for being a 'loyal' customer, writing off the remainder and starting a new 18 month deal.

    If the CEO has already conceded that you was mis-sold in terms of the length then if it hard for him to disagree with the rest of your argument. But if you did agree to an 18 month contract then it will be hard to have it terminated.

    All you can do is push your complaint further and then once you reach deadlock (or 8 weeks have passed) try submitting an application to CICAS for them to investigate.
