  • We'll have to wait for the OP to return to clarify but regardless of 3rd party buyer or not, OP has no obligation at all in this situation and doesn't need to, and shouldn't, get involved with detailing why to his customer.

This implies to me your buyer has sold it on again and is asking on behalf of their customer? If so, I cannot see you have any obligations at all.

It just looks like a standard email from Amazon.

The buyer has contacted Amazon directly, who have then forwarded it to the seller and added in their text.
  • Thanks for the help guys its much appreciated. Especially as a first time poster!
The email was sent on behalf of the buyer through amazon as she contacted them first to deal with the case. Sorry for the confusion
I didnt think i had any legal obligation to give her a refund but i thought id double check it

I think I'd reply pointing out that as you are not a business and were just a private seller selling an unwanted gift (?), you have no legal obligation to sort the fault out, especially not after 15 months, and are unable to help them, other that suggesting they take the phone to an Apple store to try and get it fixed.

I'd also phone Amazon to point out how ridiculous it is.

I'm thinking the buyer didn't know the difference between Amazon, and private sales on Amazon. Might be worth pointing this out!

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • I'd inform Amazon customer service that 'any 'Manufacturer's Warranty' is given by the manufacturer and not the seller...and hence if they wish to invoke a Manufacturer's Warranty to contact the Manufacturer.'

I'm always nervous of Amazon queries as they seem to make the most extraordinary decisions sometimes, th efact that they have even contacted the seller at all to see how they want to proceed is worrying.

I would be phoning Amazon and then follow advice above about explaining where warranty lies.

Don't contact Amazon at all - there is no need. Amazon are simply relaying a message sent to them - this happens if someone contacts Amazon about a 3rd party seller message - it's called a 'mutual customer' e-mail. The seller does not need to contact Amazon or engage anymore with the buyer. Don't panic OP - you don't need to reply or do anything.

I'm wondering if English is his first language.
