Sold Ipod Touch on Amazon buyer expecting refund because gone faulty . Advise pls

Here goes
Sold an ipod touch which was brand new in box and sealed, the ipod was sold over 15 months ago and i have received this email from the buyer
" Hello the customer has let us know that their ipod has stopped working, its overheating and won't turn on.
It isn't a problem with the power adapter and is the ipod itself. Please advise if you'd be happy to issue a replacement or for her to return it for a refund, thanks. "
At first i though it was ridiculous how the buyer was asking for a refund and i replied saying take it up with apple as i offered no warranty with it. The buyer replied with this
"This is your problem as this is under a 6 year manufacturers guarantee Consumer Rights Law I purchased this product of you and Apple say that this is your problem. As Warrant is not with them. The law states that Its down to the company I brought this item of. Every Electrical product in the UK has this."
I have only ever sold 3 items in the last 3 years so im not aware of what procedures they have in place to tackle these issues, However im left to question whether or not she has a solid basis to request a refund, or whether its completely nothing to do with me anymore. i dont believe i should refund the money because i would be left out of pocket and with a faulty ipod. What a joke!

I would agree its nothing to do with you after such a long time. They need to take it up with Apple. That's why I buy things like that from companies as you have more protection, although I'm not sure apple will replace completely free of charge either.No you're not a vegetarian if you eat any animal or fish, so do not insult genuine veggies by calling yourself one! :mad:

If your a business then you need to take these things into account.
They bought the item from you and its your responsibility to sort it.
But after 15 months I would think 6 years manufacturers guarantee, Well I am not the manufacturer so take it up with them.
Not sure how Amazon treat such cases though?Censorship Reigns Supreme in Troll City...0 -

You don't need to do anything.
Amazon allows 14 days for faults for electronic items to be reported to 3rd party sellers. He's had it for 15 months!
You are not a business and do not need to do anything further.
I would not even reply to anyone who writes 'brought' - he's either an idiot, or a chancer, and probably both.0 -
If you aren't a business the buyer has very limited protection under the Sale of Goods Act (just that the item is as described IIRC) so after 15 months they are out of luck, even if you were a business they'd need to prove a manufacturer's fault was inherent at the point of sale.
I would merely advise the buyer that the item was sold personally rather than through a business and as such you are unfortunately unable to assist further and suggest they take the item for repair or Apple will swap the iPod for a refurbished one for a charge (about £120 I think).
I don't think Amazon would get involved after such a long time, they only offer a 1 year warranty on their own items.In the game of chess you can never let your adversary see your pieces0 -

This implies to me your buyer has sold it on again and is asking on behalf of their customer? If so, I cannot see you have any obligations at all.Team Pink! Baby girl due 25/5/140 -
As the above says, they've re-sold it. This is nothing to do with you at all and their customer has no legal rights with you as the 3rd party.

They're talking rollox. The 6 years is actually with the retailer however that doesn't apply to private individuals who sell things as a private sale. If you're not a business seller and don't have a business account then you're under no obligation to deal with this. Additionally it's between the consumer and retailer not with the consumers second hand customer. They've just admitted that it's one of their customers who has had the problem so it's down to them to sort out not you.0 -

The 6 years thing is a complete red herring. There is not an automatic 6 year warranty on electrical goods AT ALL and iPods certainly do NOT have a 6 year manufacturers warranty. This link has more info http://www.whitegoodshelp.co.uk/faulty-appliances-sale-of-goods-act/
The person is either trying to deliberately confuse you by misquoting, or has a poor grasp of the law. Either way, send them this link and tell them that you can't be of assistance.0
