    Thanks for all the replies, with regards to the 3 weeks I was quoting hazyjo:

    As DRP - you can't be forced to sign up for another year. By law, you will go onto a rolling contract and he'll have to serve you two months' notice (the dates he needs to serve it on might make it nearer three months anyway).

    I know it CAN take a long time, I'm aware having tenants in isn't ideal but that's the situation. More concerned about how slow things are moving. Had the AIP on 9th July and 3 weeks later not much has happened.

    Know it's 2 months, but meant it has to be served on exact dates in order to be 2 months' notice. That might mean he has to wait three weeks or so to serve it, or that he probably won't do it that exact day and will probably take a few days to get round to it. Just saying 2 months' won't be 2 months exactly from the date you say you're moving/not signing, but is likely to be very slightly later.

    Hope that makes some sort of sense lol!

    Just to clarify further - he can serve the s.21 at any time he wants. The law does not require him to serve it on any particular date.

    It is the expiry date which is fixed - i.e. 2 months' notice and to the end of the next tenancy period. Hence might be nearer 3 months if he serves the s.21 early on in a tenancy period.

    Thanks guys, as expected the solicitor has also advised not to give notice until we have exchanged and also said not to exchange until we have vacant possession. Unfortunately the vendor was trying to negotiate 2.5 months notice rather than 3 months meaning at best they would be out around 25th Sep giving us a very small window..
  • So all very odd, contract ends in three weeks and haven't heard anything from our LL.. I obviously don't want to contact him until we have exchanged and have a completion date but just feeling a bit uneasy that we haven't heard anything.
