Help needed please, advice on seperation..

    The law has moved on albeit slowly and the fact that they have been living together as man and wife and have three children will be taken into account. But because they are not married there is no statute in law. I am no lawyer but from experience if she were married and had no pension or other assets, he has a decent job and a pension then the court would favour the majority (up to 80% or more) of the value of the house to go to her. She is entitled to reside in the house usually until the youngest turns 17 and then has to sell the house or buy him out of it for the remainder.

    If she starts off with that idea, and gets her solicitor to push for that then she should come out with more than half of the house.

    The crux of the matter lies in whether there are any other assets?

    Sorry cant be more help she needs to discuss it with a solicitor, but if she asks for a larger proportion then the worst that can happen is that the other side says no.

    He brought the eldest child home the other night, also for some clothes, but decided to stay(nothing my sister could do or say).

    He started drinking, and verbally attacked her(his partner) during the night, with various threats .

    She reported this to the police again, who took enough detail to give her a crime number, and to get a full statement later, but nothing else.

    Why do the authorities not appear to care about this threat to her.

    How can she get an injunction to stop him coming near her.

    She cant get to see her solicitor for a week.

    Anyone know the procedure for taking out/getting an injunction against him coming near her.....shes terrified he will turn up drunk one night....the police seem very reluctant to do anything because of his probation.
